A Response to Police Union Rep’s “You’re On Notice” Open Letter

Dave Mutchler, the president of the “Fraternal Order of Police” in River City, KY has issued an open letter to Americans, putting some of them “on notice.”  Mr. Mutchler’s tough talking statist attitude in his letter is just another instance of a police officer thumbing his nose at the American citizens while taking no responsibility for the many injustices taking place across the country on a daily basis while playing the victim.  Instead, he blames those that are critical of the actions of law enforcement across the country.  This is my response to his letter.  The views and opinions stated here are mine and do not necessarily represent those of Cop Block.

Mr. Mutchler, you begin your open letter to your supporters, critics, and the criminals by stating that, “The members of River City FOP Lodge 614, who serve and protect Louisville every day, will no longer stand on the sidelines while anyone continues to assault and demonize us.”  Apparently, you have forgotten that your supporters as well as your critics are your employers.  You also fail to realize that you and your brother gang members are not on the sidelines in this war for freedom.  In fact, you’re all on the front lines and have become an occupying armed enemy of the people who have ignored the oaths you took to “Support and defend the Constitution of the United States.”  In other words, you’ve brought this upon yourselves.

You first thank those that blindly support what you do and ask them to, “Rise with us against the small, but very vocal group of people in our city who resist everything we all strive to attain — freedom, safety and the ability to live our lives happily and without fear.”  If by striving to attain freedom, safety and the ability to live your lives happily and without fear; you mean, the freedom, safety and ability of police to live and act without public scrutiny and accountability, you’ve got another thing coming.  Those that blindly support your misdeeds are already asleep at the wheel and can’t be bothered to rise up against anything.  I can assure you that these sleeping sheep are slowly waking up to the realization that your actions are whittling away at their freedoms piece by piece. They too will have had enough and turn on you eventually.

In the next part of your letter, you address the criminal element by stating, “We do not fear you.”  Really?  Can you explain the almost daily instances of officer related shootings of citizens; most of which are unarmed, where the officer says in his report that he used deadly force because he “feared for his life?”  Let’s be honest here.  A majority of police officers in this country are under trained, under educated, and out of shape.  The screening of candidates for the police force also leaves a lot to be desired, as well.  How many mentally defective people “slip through the cracks” during your selection process?

The numbers do not support this supposed fear that police have of the public.  According to the National Law Enforcement Officers Memorial 2015 report on causes of death for officers, 117 officers died in the line of duty during 2015.  The breakdown of causes of death are:  Car Crash – 32, Drowned – 2, Motorcycle Crash – 6, Physical-Related Incident (health issues) – 18, Shot – 48, Strangled – 1, Struck by Vehicle – 10, Terrorist Attack – 0.

Those numbers do not support the claims that Law Enforcement Officers put their lives on the line everyday in serving the public.  In fact, the U.S. Department of Labor lists police work at number 14 in their list of most dangerous jobs.  There is no denying that police work can be dangerous, but propaganda by police unions across the country try to lead the American public to believe that your work is more dangerous than it really is.

At this time there have been at least 530 civilians killed by the police nationwide so far in 2015.  There is no denying that there are instances when it is necessary to take a life to protect innocents from loss of life.  The problem here is the growing number of unarmed people being shot and killed by American police.  These deaths can be attributed to actions by the police deemed by even your policies to be illegal such as the use of choke holds, unwarranted use of tasers, blunt objects, and firearms.  Both Amnesty International and the UN have spoken out against the heavy-handed tactics of U.S. police forces.

Somewhere over the last decade these officers has decided to become Judge, Jury, and Executioner rather than allowing these people their rights to due process under the law.  You then investigate yourselves and find that you did nothing wrong.  You as a Police Union President and other union reps are the largest problem in this tragedy.  You fight so hard to protect your own special interests by doing whatever you can to ensure these obvious criminal officers do not face true justice.  Essentially, police unions are the root cause of the current situation you now find yourselves in with the hate and mistrust of your officers by a growing number of the public.

I’m going to break down the next part of your letter a little at a time as you actually make some valid points as well as some ridiculous ones as well.

To the sensationalist, liars and race-baiters —we are done with you. At first it was good enough just to sit back and watch your ridiculous spectacle. No more. Now your rhetoric, lies and hate puts all of us, police officers and citizens alike, in danger. From now on we will call you out each and every time you tell a lie, twist the truth or otherwise engage in vile behavior meant to push your selfish agendas. If your behavior or untruths causes harm to us or the public, we will make every attempt to have you investigated, charged and prosecuted at the local, state or federal level. Your idiocy and lies are what caused the destruction in Ferguson and other cities around our country and we won’t be tolerating that here. We watched in shock most recently as some of you flat-out lied to the media after a critical incident here in Louisville. Many in the media are self-serving too, and we watched as they stood on the sidelines and fanned the flames for financial gain.

I am in total agreement that there are those out there that have their own agenda.  People like Al Sharpton have used many real tragedies for face time on the news to further their own unscrupulous interests.  The rioting and looting that took place in Ferguson was uncalled for and did nothing to address the real issues at hand.  That is where my agreement with you ends.  While the rioting was wrong, you are denying that it was a symptom of citizens that are fed up with the abuse and oppression that they were subjected to over the years by the police in that city.  Recent history of Ferguson demonstrates that this city was a literal pressure cooker with no release valve, destined to blow up.  That is exactly what happened.  This is a city of people who the system had failed time and again.  These were people who realized that their cries of injustice fell on deaf ears.  Whether the shooting death of Michael Brown was justified or not, the damage was already done prior to that and his death was the catalyst that set the stage for the destruction we all witnessed in Ferguson.

Any time the media paints a pretty picture of your officers, you pat yourselves on the back and your egos inflate.  As soon as anything critical is written about the police, you are quick to cry foul regardless of the evidence presented.  Immediately you jump into damage control mode and use whatever means to justify any actions that come into question by the media.

It is obvious to nearly everyone that you are attacking and lashing out at the police instead of attacking the real problem — those who commit crimes in our city and those who enable the criminal element. Are you not paying attention to what is happening around the country? As police are disempowered the predominately minority areas of cities, including Louisville, are suffering at the hands of killers and violent felons. Yet you continue to attack law enforcement. Your attacks can’t stop the truth from shining through. The truth is that every day there are millions of encounters during which police officers interact peacefully with all kinds of people, even during very difficult circumstances.

There is no denying that there are police officers out there that want to do the right thing and have a genuine love for their communities, but there is also a growing number of police officers that have no respect for the law and feel that their badges somehow give them some special powers to do as they please whether it is legal or not.  You ask if we are not paying attention to what is happening around the country.  Yes we are and that is why you are so up in arms. We are exposing police corruption on a daily basis and you’re in total denial.

These officers are the focus of many of the groups that you have labeled as anti-police.  These groups of police accountability activists are growing in numbers and more of these dirty cops are being exposed with video evidence that investigators continue to turn a blind eye to.  If you wish to call the exposure of police brutality and corruption as an attack on your self-declared truths, so be it.  You can continue to deny and deflect all that you want, but your excuses and justifications for the wrongful actions of officers across the country are getting old.  Your claim of there being millions of daily encounters where officers interact peacefully with all kinds of people is quickly being overshadowed by the growing number of videos being shot on a daily basis that counters your claim.

Your flawed logic and lack of reason regarding events that occur in our society makes you appear stunningly inept. Let me help you. All citizens in Louisville, regardless of race, creed, color, gender or national origin have the SAME rights and responsibilities. No one gets a separate set of rules. Politicians may fear you and your tactics-we do not. You and those you enable must abide by the law and comply with law enforcement like everyone else. If you refuse to comply or even worse, attack a law enforcement officer, expect to be met with force.

complyAll citizens, regardless of race, creed, color, gender or national origin have the same rights and responsibilities unless you are a cop.  For some reason you officers think you have special rights because of that badge you wear.  Let me help you. NO, you do not have special rights because of that badge.  You are public servants paid for with the American tax dollar.  You are bound by the same laws as any other citizen.  That badge does not give you the right to bully citizens with illegal detentions.  Your badge does not give your officers the right to drive recklessly, speed, run red lights, and park illegally while turning around and extorting money through the writing of tickets to the everyday citizen in an effort to generate revenue for your municipalities.

Your lack of fear of our tactics, will be your undoing.  Your inability to comprehend that we are not bound to follow unlawful orders by law enforcement and your threats of violence show your own flawed logic and reasoning.  My belief is that the continued use of force against those that refuse to follow unlawful orders by the police will in return be met with force.  One of our Founding Fathers, Thomas Jefferson, once said, “If a law is unjust, a man is not only right to disobey it, he is obligated to do so.”

Your ridiculous demands and anti-law enforcement attitude has reached a level that is unacceptable. You want our attention? Well you have it. Consider yourselves on notice. We challenge you to have the same integrity and dedication to serving the community that you say you seek in the police. We already have it. You need to get it.

Our demands for you public servants to honor your oaths and do your jobs correctly are in no way “ridiculous.”  They’re actually in your job descriptions.  The Constitution of the United States is not a document of suggestions, it is the Law of the Land in which you are duty bound to follow.  I’m glad to have your attention.  Now that I and many others across the nation have your attention, stop deflecting blame for your public image and do the obvious right thing and honor your oaths.  If we had the same “integrity” as you and your fellow gang members, our country would be in even worse shape than it is now.  Your statement that you have integrity doesn’t make it so.  Consider ourselves on notice of what exactly?  Are we on notice that you are going to ramp up your attacks on our civil liberties?

Dave Mutchler and the rest of law enforcement across the United States, consider yourselves  on notice.  On notice that we will no longer enable you to violate your oath.  We will continue to expose your illegal actions and wake up the American public to your continued attacks on our inalienable rights protected by our Constitution.  The numbers are not in your favor.  According to the FBI’s Police Employee Data

  •  A total of 14,633 law enforcement agencies in city and county population groups provided data on the number of full-time law enforcement employees (sworn officers and civilian personnel) on staff in 2011.
  • The rate of sworn officers was 2.4 per 1,000 inhabitants in the nation in 2011.  The rate of full-time law enforcement employees (civilian and sworn) per 1,000 inhabitants was 3.4.  (Based on Table 74.)
  • Cities with fewer than 10,000 residents reported an average of 3.5 officers per 1,000 inhabitants, the largest officer-to-individual rate among city population groups.  (SeeTable 71.)
  • County agencies reported an average of 2.7 officers per 1,000 inhabitants.  (SeeTable 71.)
  • In 2011, sworn officers accounted for 69.7 percent of all law enforcement personnel in the United States.

The reality is that you are outnumbered and your days of abusing the citizens of this nation are coming to a close.

Your open letter serves an important purpose, but not in the way you intended it to.  By putting us on notice, you have exposed your attitude of the “Us versus Them” mentality.  You have driven a bigger wedge between yourselves and those you claim to serve.  You have already crossed one line and drawn a new line that a growing number of Americans are not afraid of crossing to hold you accountable.

Rather than crying about your public image and pointing fingers at us, take a deep look into yourselves and your actions.  Stop defending the corrupt officers out there.  Recognize that you work for us.  Recognize your own shortcoming and correct  your actions and the actions of your brothers in uniform.  Lastly, I challenge you to do the right thing and honor your oath.
