In Utah, Judge Scott Johansen ordered the state’s division of child and family services (CFS) to remove a baby from lesbian foster parents and place the child with a heterosexual couple “for the child’s well-being”.

Foster parents April Hoagland and Beckie Peirce were members of a group of same-sex couples who had been approved for foster care by CFS after the Supreme Court legalized same-sex marriage.

The ruling hurt the 2 women because they had not “done anything wrong” other than being lesbians.

Johansen said in court that there is “a lot of research that indicated children who are raised in same-sex parent homes do not do as well as children who are raised by heterosexual parents.”

However, a major study published in 2014 showed that kids raised by same-sex couple actually fair better “than the general population on measures of general health and family cohesion.”

Opponents to same-sex couples raising children quote a well-known paper by sociologist Mark Regerus, who did not study children raised by same-sex couples. Regerus targeted children of heterosexual unions that ended in break-up or divorce where one parent had a romantic relationship with someone of the same sex.

In addition, the study encompasses participants who “grew up in the 1970s, 80s, and 90s, long before marriage equality was available or adoption rights were codified in many states.”

Regerus is a social conservative who engages in studies from a Christian morality stance on sexuality and happens to produce papers than paint same-sex couple is a less than favorable light.

This is not surprising considering that the study was funded by the Witherspoon Institute and Bradley Foundation; 2 conservative groups tied to anti-gay organizations like the National Organization for Marriage.

Despite the judge’s objections, both the attorneys for CFS and the birth mother of the child say that Hoagland and Peirce should remain the foster parents.

CFS spokeswoman Ashley Sumner said this ruling “raised concerns at the agency … [and] it’s attorneys plan to review the decision and determine what options they have to possibly challenge the order.
