Christian Pharmacists Can Refuse Birth Control Prescriptions in Oregon, California

At the first of 2016, Oregon law has allowed for birth control pills to be acquired without a prescription. Residents over the age of 18 who live in Oregon can now purchase birth control pills from pharmacies within state borders.

After filling out a health questionnaire, a yearlong supply of birth control pills will be available via the authority of the pharmacist thanks to a bill signed by Governor Kate Brown in July of 2015.

The new law reads in part: “In accordance with rules adopted by the State Board of Pharmacy under ORS 689.205, a pharmacist may prescribe and dispense hormonal contraceptive patches and self-administered oral hormonal contraceptives to a person who is: (a) At least 18 years of age, regardless of whether the person has evidence of a previous prescription from a primary care practitioner or women’s health care practitioner for a hormonal contraceptive patch or self administered oral hormonal contraceptive; or (b) Under 18 years of age, only if the person has evidence of a previous prescription from a primary care practitioner or women’s health care practitioner for a hormonal contraceptive patch or self-administered oral hormonal contraceptive.”

In California, a similar law has been passed that allows women over the age of 18 to obtain birth control pills via the authority of a local pharmacist.

The 2 states also mandate that pharmacists will be required to “undergo training before” they can prescribe birth control. Those pharmacists can “also refuse to write prescriptions for religious reasons”; however they will be legally responsible for referring “the customer somewhere else”.

While access to birth control is important, there are some snags that this effort might have to deal with in the near future.

According to the National Women’s Law Foundation (NWLF), pharmacies located in 25 states refuse to fill prescriptions for birth control, including Oregon. The reason for this blockage of women’s medical healthcare is religiously based, rather than based on medical or professional concerns.

Going back 10 years, instances of pharmacists across the US “refusing to fill prescriptions for birth control pills” have been published by news outlets.

Religious groups such as the Christian Legal Society’s Center for Law and Religious Freedom have defended Christian pharmacists who have violated women’s rights to reproductive protection in favor of their deeply held religious beliefs.
