Conservative Justice Thinks Black Students Belong in “Slower-Track” Schools

Supreme Court Justice Antonin Scalia argued that African American students who attend the University of Texas at Austin (UTA) would “do well” to go to “a slower track school” because they belong in “a less advanced school”.

US Solicitor General Gregory Gerre, representative of UTA, was speaking with Scalia when he made these comments. It is the contention of the university that race be one of the factors that determine their admissions program.

UTA maintains that the university “suffers from lower minority enrollment”.

Scalia claimed: “Most of the black scientists in this country don’t come from schools like the University of Texas. They come from lesser schools where they do not feel that … they’re being pushed ahead­­ in classes that are too fast for them.”

The Justice said he does not “think it stands to reason that it’s a good thing for the University of Texas to admit as many blacks as possible. Maybe it ought to have fewer. And maybe, when you take more, the number of blacks, really competent blacks, admitted to lesser schools, turns out to be less.”

Garre responded: “I don’t think the solution to the problems with student body diversity can be to set up a system in which not only are minorities going to separate schools, they’re going to inferior schools.”

He added: “If this court rules that the University of Texas can’t consider race, we know exactly what will happen: diversity will plummet, especially among African Americans.”

Chief Justice Roberts expressed his disdain for how long such programs of affirmative action were allowed to go on.

Roberts said: “”Are we going to hit the deadline? Is this going to be done, in your view, in 12 years?”
