Former judge sentenced for violating defendant’s civil rights

Robert Nalley, a former judge in Charles County, Maryland, was recently sentenced for his “shocking” behavior in a trial over which he presided.

During jury selection for a case in 2014, Judge Nalley ordered the defendant to be physically shocked. The defendant, who was representing himself during the trial, objected to Judge Nalley’s authority to conduct the proceedings, repeatedly ignored the Judge’s questions and disobeyed his commands to stop speaking. The defendant was wearing a “stun-cuff” around his ankle and Judge Nalley ordered the deputy sheriff to activate it. An electric shock was administered for about five seconds. The defendant fell to the floor screaming after he was shocked. He has stated that the electric shock impaired his ability to act as his own lawyer when the trial resumed.

Shortly after the incident Judge Nalley’s authority to hear cases was rescinded by the Maryland Court of Appeals. He was charged with a civil rights violation and faced a maximum sentence of a year in jail and a fine of up to $100,000. However, he reached a plea agreement which requires him to take anger management classes and pay a fine of $5,000. He was also placed on probation for a year.

At his appearance in court, Judge Nalley did not apologize for ordering the stun-cuff activated, but admitted he had made an error in judgement. He also acknowledged that activating the stun-cuff was unreasonable under the circumstances.

In 2010, Judge Nalley deflated the tire of a cleaning woman’s car that was parked in a restricted zone at the courthouse. He pled guilty, was fined, had to write a letter of apology, and was suspended for five days without pay.
