Facebook recently banned the private sale of firearms on their social media platforms; including Instagram. To keep watch for violators, users are encouraged to tattle-tale on others.

In January, Facebook differentiated between licensed firearms dealers and placed a ban on private individuals selling and purchasing guns using their platform.

This prohibition includes the sale of purchase of:

• Gun parts
• Ammunition
• Targets private
• Person-to-person gun sales

These business transactions do not require a background check in many states. And because of these loopholes, social media has become a popular place to sell and purchase firearms.

• The process takes 15 minutes
• Anyone, even a minor, could access Facebook groups to arrange a purchase

According to Journalist Richard Byrne Reilly “a VentureBeat reporter and his colleague spent less than 15 minutes arranging to buy a semiautomatic 7 mm rifle and 90 rounds of ammunition from a guy named “Dave,” a member of Facebook “Firearms Only Alamogordo” fan page.”

And in many cases, the arms sellers on Facebook openly admit that they do not conduct background checks.

Facebook groups helped William Kurtz sell his AR-15 in a swap for a semi-automatic handgun in 2014. The problem with that transaction was that Kurtz was an adjudicated delinquent , which means he was legally prohibited from purchasing, owning or possessing any gun in any capacity.

Kurtz was caught trying make this swap, and when police investigated his home, they found numerous firearms; including a second AR-15, several magazines and rounds of ammunition, and rifle sights.

Monika Bickert, head of product policy for Facebook, explained: “Over the last two years, more and more people have been using Facebook to discover products and to buy and sell things to one another. We are continuing to develop, test and launch new products to make this experience even better for people and are updating our regulated goods policies to reflect this evolution.”

However, the tech giant has also launched new tools for purchasing and selling within groups on Facebook which has now become an online flea market for firearms; including military weapons being sold to patriot militias and terrorists.

For terrorists working in countries where the Islamic State is invading, this method of obtaining a gun is quick and easy. In fact, an estimated 6,000 trades for weaponry has occurred across the Middle East.

Knowing it is easy to purchase a gun via Facebook is concerning when it is also taken into consideration that there is no prohibition for a known and suspected terrorist to preclude them from purchasing a gun legally under current federal laws.

According to a 5 year old report from the Government Accountability Office (GAO), “membership in a terrorist organization does not prohibit a person from possessing firearms or explosives under current federal law.”

Thanks to gun laws influenced by the National Rifle Association (NRA), it is not illegal for people on the Federal Bureau of Investigations (FBI) consolidated terrorist watch list (CTW) to buy a firearm from a gun store; including semiautomatic guns and/or assault rifles.

It is important to note that those on the CTW are under “reasonable suspicion” for having known or are a suspected terrorist.

The GAO discovered that between 2004 and 2014, 2,233 attempts to purchase guns by suspected terrorists from American gun dealers. And 91% of the time, the terrorists were successful; which translates to 2,043 guns.

To date there are an estimated 700,000 people on the CTW.
