According to a new report on developments in the investigation being conducted by Special Prosecutor Robert Mueller, the top attorney is setting up interviews with intelligence officials as part of his probe into Russian interference in our last election.
Mueller is also investigating Donald Trump for attempting to obstruct justice by firing former FBI director James Comey.
The special prosecutor has contacted NSA director Mike Rogers, Director of National Intelligence Dan Coats, CIA director Mike Pompeo and NSA deputy director Richard Ledgett asking for interviews as part of an obstruction inquiry. Reportedly, all 3 have agreed.
It is important to note that Rogers and Coats both refused to answer questions concerning interactions with Trump when appearing before the Senate Intelligence Committee in an open hearing a week ago.
Coats told Senator Marco Rubio that he was “not prepared to answer your question today” after being asked by Rubio if he had “been asked by the president or the White House to influence an ongoing investigation.”
Coats declined Rubio, saying: “I’m not going to discuss the specifics of discussions with the president of the United States.”
Trump has been on an obsessive quest to convince everyone the he was not personally under FBI investigation, a subject confirmed by Comey during testimony to the Senate Intelligence Committee last week.
However, the story put forth by Comey about Trump’s repeated attempts to obstruct the FBI’s investigation into Trump associates, specifically former National Security Adviser Michael Flynn, whom Trump asked Comey to “let go” have prompted Mueller’s interest as a part of the larger Trump-Russia probe.
The legal definition of obstruction of justice as stated in 18 U.S.C. § 1503, describes a person who “corruptly or by threats or force, or by any threatening letter or communication, influences, obstructs, or impedes, or endeavors to influence, obstruct, or impede, the due administration of justice, shall be (guilty of an offense).”
This definition is broad and involves proving the person willfully interfered in the administration of justice. CNN analyst Jeffrey Toobin argues that went Trump cleared the room in order to speak to Comey alone about letting Flynn go “suggests consciousness of guilt.”
Claire Finkelstein, professor at the University of Pennsylvania’s School of Law, explained: “Requesting on multiple occasions that Comey do things like drop the Flynn probe and publicly announce Trump is not under investigation is one thing. [But] implicitly suggesting he may not keep his job and then firing him when he doesn’t absolve you personally in a dispassionate and objective investigation — that looks a lot like obstruction of justice.”
The timeline of events is of interest with regard to obstruction of justice. Comey was fired on May 9th and the next day Trump reportedly told Russian foreign minister Sergey Lavrov and Russian Ambassador Sergey Kislyak that getting rid of that “nutjob” Comey had “relived a great deal of pressure” with regard to the “Russia thing”.
And after several days of White House Press Secretary Sean Spicer, deputy press secretary Sarah Huckabee Sanders and many spokespersons for the Trump administration appearing on television to push the narrative that Comey was fired because of a combination of losing confidence of the “rank-and-file at the FBI” and his handling of the Hillary Clinton email matter, Trump admitted to NBC’s Lester Holt that “the Russia thing” was on his mind when he (alone) decided to fire Comey.
Mueller probe is expanding to include potential financial crimes committed by Trump associates which is an expansion of the original probe.
