Retired judge loses bid for pension boost

A retired Queensland judge has failed in a legal bid to get a pension increase.

Walter Henry Tutt reached the mandatory retirement age for a District Court Judge last May.

Under current pension arrangements, judges who retire with less than 10 years’ service are entitled to six per cent of their salary for each completed year.

Judge Tutt’s 70th birthday came just a few days short of his eighth anniversary as a judge.

The State Government calculated his entitlement at 42 per cent of salary, or $140,000, based on seven years of service.

Judge Tutt asked the Supreme Court to consider whether a pro rata arrangement should be applied to the 353 days he served after his seventh anniversary.

The court has ruled that pro rata should not be applied under the act.
