TX Gun Enthusiasts Cry Lawsuit After 20 Colleges Reject Campus Carry

Over 20 private higher education schools in Texas have rejected a recent bill allowing for guns to be in college classrooms, including Baylor, Texas Christian and Southern Methodist University (SMU).

Ken Starr, president of Baylor University, told the media that this move by the state legislature is “a very unwise public policy”.

Among those in opposition to this law is William McRaven, chancellor of the University of Texas and former head of U.S. Special Operations Command who directed the raid that killed Osama bin Laden, who agreed with law enforcement, students and faculty that guns on college campuses will mean “trouble”.

Gregory Fenves, president of the University of Texas at Austin, wrote in a letter : “I do not believe handguns belong on a university campus, so this decision has been the greatest challenge of my presidency to date. I empathize with the many faculty members, staffers, students and parents of students who signed petitions, sent emails and letters and organized to ban guns from campus and especially classrooms. As a professor, I understand the deep concerns raised by so many. However, as president, I have an obligation to uphold the law.”

Thanks to republican lawmakers in Texas, the “campus carry” law mandates that “public universities to allow concealed handgun license holders to bring their weapons into campus buildings and classrooms.”

Texas state senator Brian Birdwell, author of the law , asserts that he was forced to protect the “God-given” right to self-defense, via the 2nd Amendment on public and private property.

Birdwell took the martyr approach to justifying this bill by saying: “[Private universities are] no different than Starbucks selling coffee. What they are selling is different. Now it’s up to the marketplace of free enterprise … to make a market decision,” about guns on campus. My duty was to preserve their ability to make that choice.”

The new gun law affords guns rights in the classroom, but not in the dorm rooms; unless it falls under 3 exceptions:

• Concealed guns allowed in common areas
• Family members visiting dorms can carry their guns with them
• Staff working can carry guns into dorms

With regard to the safety measures placed on these new gun carry allowances:

• Students must keep guns “on or about their person” at all times
• Guns must be locked in cars when not carried
• Gun safes are allowed in university apartments
• Guns will be kept in their holster
• No loaded weapons

In a show of pro-active force, organizations such as Students for Concealed Carry (SCC) revealed in a statement their “Texas chapter will now shift its focus to litigation” to ensure that their right to carry is upheld.

SCC also question policies including “gun-free offices and prohibiting carriers of semiautomatic handguns from carrying with a chambered round claiming they “will not stand up to legal scrutiny”.
