Those raw milk proponents advocating “teach, teach, teach” may want to enroll Wisconsin Judge Patrick J. Fiedler in their first class–in the kindergarten section.

In response to a request from the Farm-to-Consumer Legal Defense Fund, the judge issued a clarification of his decision last week regarding his assessment of the constitutionality of food rights. The judge expanded on his original statement that such constitutional issues are “wholly without merit.”

He explained that the FTCLDF arguments were “extremely underdeveloped.” As an example, he said the plaintiffs’ use of the Roe v Wade abortion rights case as a precedent does “not explain why a woman’s right to have an abortion translates to a right to consume unpasteurized milk…This court is unwilling to declare that there is a fundamental right to consume the food of one’s choice without first being presented with significantly more developed arguments on both sides of the issue.” Gee, I thought they both had to do with the right to decide what to do with your own body.

As if to show how pissed he was at being questioned, he said his decision translates further that “no, Plaintiffs to not have a fundamental right to own and use a dairy cow or a dairy herd;

“no, Plaintiffs do not have a fundamental right to consume the milk from their own cow;”

And in a kind of exclamation point, he added this to his list of no-nos: “no, Plaintiffs do not have a fundamental right to produce and consume the foods of their choice…”

You have to wonder if maybe even the regulators are getting a tad uncomfortable with the rulings coming from the nation’s judiciary on food rights. Many of these individuals, biased as they are against raw milk, dabble in farming to some extent, or grew up on farms. This judge has gone way beyond what many of them have come to assume–that everyone has the right to own a cow and consume its milk Even in places that ban raw milk sales, there’s nearly always a provision in state law that anyone who owns a cow has the right to consume its milk.

  2. Everyone of you people missed what the judge was saying. If you wholly or in-part own a cow and it’s either at your house/farm or other owner’s house/farm then that’s ok to consume your milk, BUT if you own several dairy cows and all of them are at your farm and/or partners farm then you are running a dairy farm which is a business and that is not OK to drink without complying with state law as all other dairy farms in the state.

      • upholding the law against common sense is hard work. somebody feed that judge some raw milk, keep his strength up.

    • And how is it a dairy farm business if no milk is sold? Quantity of the means of production has nothing to do with the means of disposal of the product.

  3. Judge Patrick J. Fiedler would do most people a favor by simply killing himself. He’s definitely doing the tyrants a favor by fraudulently occupying with them as one of them.

    You have two cows. At first the government regulates what you can feed them and when you can milk them. Then it pays you not to milk them. After that it takes both, shoots one, milks the other and pours the milk down the drain. Then it requires you to fill out forms accounting for the missing cows.

    You have two cows. The government takes them and denies they ever existed. Milk is banned.

  8. In Canada, you cannot buy milk, organic or not, without 45% of one “day’s nutritional value” of
    vitamin D added to every cup. You can NOT buy milk without it – or less than 45%. Its force medicating, esp since only 10 minutes of outside sun is one day’s full value.

    Vit D is stored in the body – it accumulates and too much is bad – causes cancer – check the MSDS on it, if you’re curious.

    • A few years ago at a time when I was eating a lot of canned salmon which is loaded with vit D, I injured my thumb. It was minor and should have healed w/out incident but I developed a calcification around the injury. The doctors were puzzled as to why. After many months I figured it out and started being careful not to get too much vit d. Practically overnight the big swelling in my thumb disappeared and the calcification stopped growing.

      On account of the greatly increased radiation in milk, courtesy of Fukushima, I’d like to buy a name brand vanilla soy milk, but it’s got 45 freaking percent vit d per glass (in the usa), so I leave it at the store. The store brand tastes a little off and has 30% vit d/glass so not worth it. And it’s too easy to go way overboard on calcium with so many products supplementing it.

      Recent research has shown too much calcium is bad for the cardiovascular system.

    • Too much vitamin D is bad? Tell that to a lifeguard… who gets upwards of 40X the daily dose of vitamin D daily, just being out in the sun.

      Your body only stores parental vitamin D3… an inert precursor to the biological hormone, 1,25-dihydroxyvitamin D3, which is so potent, it’s regulation is tightly coupled to a catabolic enzyme called CYP24A1, which rapidly metabolizes it’s side chain, so it can be excreted in the urine.

      If anything too little vitamin D is the cause of cancer. Many tumors have been found to upregulate the CYP24A1 gene… which means, no matter how much vitamin D you have in your body.. the tumor will metabolize it all away. Some believe this defect is a key promoter of cancer, because one of the broad effects of the vitamin D hormone, is that it induces differentiation in rapidly dividing cells… so with no vitamin D… your cells just proliferate naturally.

      So please don’t spread disinfo on the D… New evidence suggests 70% of Americans are deficient in circulating levels of 25-hydroxyvitamin-D3… this is caused by lack of sunlight, and poor diet… African Americans and Women are particularly at risk…

      I’d recommend 2,000-10,000 I.U’s per day, depending upon your body size. That or 15-45 minutes of direct sunlight between 11 am – 2 pm, depending on how dark your skin is.

    I imagine that the Patriot freedom fighters will find him wherever he tries to hide.
