A man will face a fine of $2,000 for each cigar he will smoke inside an apartment, according to court proceedings in New York.

The New York man settled a lawsuit by agreeing to pay $2,000 to his neighbors if he is caught smoking a cigar inside his apartment in the future.

 

The $2 million lawsuit, was filed in the Supreme Court New York City by Russell and Amanda Poses, who claimed that next door neighbor Harry Lysons is stinking up their apartment by smoking cigars inside his home, a local New York newspaper reported Thursday.

 

Lysons settled the lawsuit by agreeing to pay a fine of $2,000 for each future incident involving cigars inside his home.


The Poses family said that the smoke was causing health problems for their children, 3 and 6-years-old.

 

“Each party is required to ensure the access of others to their apartments, with reasonable notice to verify that the apartments do not smell of cigar smoke emanating from the defendants smoking of cigars in the prohibited areas,” the settlement reads.

“They could have placed a fine of one million dollars and it would have been fine with me, because my client did not smoke cigars in any apartment,” Jeffery Marcus, the attorney of Lysons, said.
