Cape Cod Man STILL Fights for Justice After Four Long Years!

DJ Alvzie is, if you haven’t guessed, a DJ. While working back in 2012 he was assaulted by a number of police officers including one DEA agent. His story is horrific and I applaud Alves for his continued pursuit of justice. His case really shows how far police will go to back and protect one another.

My original story as aired on FOX 25 Boston:

April 2012:

State lost their criminal trial against two Boston Police Officers. Both Officers were acquitted of Assault and Battery charges.

I immediately filed a lawsuit against the Officers and the Venue involved.

May 2015:

I lost that suit and was found to be 60% responsible for my injuries, the venue was found 40% responsible and the “Officers” were found to be 0% responsible for my injuries.

Banner - cell 411Banner - cell 411The Barnstable Police Department and Barnstable Assistant District Attorney obstructed justice in their criminal investigation and prosecution of DEA Agent John Daly. Mr. Daly and his fellow intoxicated and off-duty law enforcement colleagues beat me while I was working in an apparently racially-motivated attack (from sworn testimony, some officers were heard saying “fucking nigger” repeatedly during the attack). Mr. Daly admitted to being involved in this attack and was witnessed attacking me by several people including an employees of that establishment.

Mr. Daly also dropped his cell phone (which I recovered) due to the force of him kicking me, as other officers pinned me to the floor. The attack was witnessed by many patrons, who have provided sworn testimony. From an ambulance stretcher, I handed Mr. Daly’s cell phone to a Barnstable police officer after the long ordeal, which involved two separate beatings and the off-duty police officers surrounding the bar and not allowing me to leave.

District Attorney Michael O’Keefe and the Barnstable Police Department’s investigation did not result in any charges being levied against Mr. Daly, and no officer was ever convicted. In sworn testimony, the police officer who organized a “photo lineup” for me to review *did not* include a photo of Mr. Daly.
Mr. Daly’s statement from the night of the incident, where he stated he was involved in a “scrum” was either not entered into evidence or not properly considered during the criminal trial.
Questions which should be asked of the Barnstable DA and the Barnstable Police Department are:
1) why was Mr. Daly never criminally charged and
2) why was his photo not part of the photo lineup shown to me.

The failure of the criminal prosecutorial team to faithfully uphold their duty to investigate Mr. Daly’s criminal acts against me, were directly responsible for the parallel failure of any witness to be able to positively identify Mr. Daly (recall that his photo was never part of any photo lineup). That failure also affected my civil trial, since a defense attorney during this trial made a point to emphasize the fact that no one ever identified Mr. Daly.

This clear breach of justice in Massachusetts regarding the failure to faithfully prosecute white officers in such an obvious police brutality case against a minority means that this national problem is also a local one to Massachusetts, which should not be allowed to continue. DA O’Keefe and the Barnstable Police Department should be held to account, so that other prosecutors and agencies understand the seriousness of this problem and the necessity that everyone, even our law enforcement personnel, be treated equally and fairly under the law.
