Convicted murderer Gordon Wood to learn fate tomorrow



GORDON Wood will learn tomorrow the outcome of his appeal against his conviction for the 1995 cliff plunge murder of his girlfriend Caroline Byrne.


The NSW Court of Criminal Appeal, which heard Wood’s challenge over eight days last August and September, is to hand down its decision in Sydney tomorrow at 3pm (AEDT).

In 2008, Wood, then 46, was found guilty of murdering Ms Byrne, 24, by “spear throwing” her off a cliff at The Gap, a notorious Sydney suicide spot, late on the night of June 7, 1995.

He was jailed for at least 13 years after the jury rejected a claim that Ms Byrne, whose mother killed herself in 1991, had jumped off the cliff.

At the appeal before Justices Peter McClellan, Megan Latham and Stephen Rothman, Wood’s barrister, Tim Game SC, relied on nine grounds.

They included a submission that the scientific evidence and opinions of a crucial crown witness, Associate Professor Rod Cross, caused the trial to miscarry.

Mr Game submitted that Wood was entitled to an acquittal, or, at the very least, his conviction should be quashed and a new trial granted.

Wendy Abraham QC, for the crown, said if the court allowed the appeal there should be a retrial.
