Jury Tampering in Tamir Rice Case Cost Prosecutor McGinty His Job

According to an Associated Press report , African Americans voting in Cleveland “played a large role in defeating” Cuyahoga County Prosecutor Tim McGinty’s reelection because of “his handling of an investigation into the death of Tamir Rice.”

By looking at voting data, AP ascertained that “70% of voters in majority black precincts in the county voted for” Michael O’Malley, a suburban safety director who is also a form assistant county prosecutor.

In the end O’Malley received 56% of the vote in the democratic primary and 64% of that came from Cleveland.

Part of the reason for this ousting of McGinty came from campaigns by “black leaders, ministers and the black community at-large.”

McGinty was adamant that a grand jury decide whether or not Officer Timothy Loehmann and his accompanying officer should be charged with the death of Tamir Rice because he had already “recommended” that no charges be filed.

And the grand jury agreed with McGinty because they heard his side of the story – and only his side of the story.

In a 70 page report by McGinty, he claimed the officer’s account of the events were “consistent with the evidence in this case” and had the jurors “review arguments on behalf of potential police defendants, not to prosecute them.”

And just recently, McGinty reiterated his point by declaring : “Justice would not be achieved by bringing charges that would violate the ethical canons of our profession because we know these charges could not be sustained.”

Yet this is a far cry from the intention of grand juries as it was written into our Constitution, and further confirmed by the Supreme Court in 1992 who clarified that the purpose of a grand jury is to confirm there is some legal “basis for bringing a criminal charge”.
