Summary Box: Court reinstates case against YouTube

RESURRECTION: A federal appeals court has revived a 5-year-old copyright case against YouTube by Viacom and other copyright holders.

THE REASON: The court says a jury might conclude that the online video service knew it was infringing rights when it allowed the distribution of videos of popular television shows and other programs. The lawsuit had originally been dismissed without a trial.

BOTH SIDES CLAIM SATISFACTION: YouTube portrays Thursday’s decision as a victory, saying the court “rejected Viacom’s reading of the law.” Viacom is happy it gets another chance and says it’s confident it will prevail.
