Colorado shooting: Suspect James Holmes makes first court appearance

17.20 (10.20) Holmes shuffled into the court with shackles around
wrists and ankles. He wore white socks and burgundy prison scrubs and
possibly a stab-proof vest underneath.

17.05 (10.05) Chambers says she has “no information” on
Holmes’s confusing demeanor inside the courtroom. She says the death penalty
is “very long process” that would affect victim’s families lives
for years and so no decision will be made until they’ve consulted widely.

17.00 (10.00) Some of the victim’s families watched from a room inside
the court house on closed circuit television while others sat inside the
courtroom itself.

16.55 (09.55) One of the key questions prosecutors are likely to be
asked: will you press for the death penalty? Chambers has already
said that the decision will be made in consultation with the victims’
families and may not be made for months.

16.50 (09.50) We’re about to have a press conference with prosecutors
led by Carol Chambers, Arapahoe County District Attorney. We
apologise for the poor sound on the live feed during the court hearing.

16.43 (09.43) Holmes has just been escorted out of the
courtroom. Everyone was fixated on his expression – a combination of
mournful and oblivious. He head rolled and he seemed to have little idea of
where he was or what was happening. Is he traumatised or is it some sort of
medication?

16.37 (09.37) The judge says there will “clearly” be no bail
for someone accused of such a serious crime. He orders charges to be
formally filed on July 30.

16.35 (09.35) Holmes looks almost sedated, like he barely has any idea
what’s going on around him. He seems to be struggling to keep his eyes open.
There’s a woman sitting next to him in the dock – it’s not clear if she is a
lawyer. A half dozen guards are posted throughout the courtroom.

16.32 (09.32) Holmes looks exhausted – his face stretching into
grimaces as his head lolls. His hair is dyed a faded orange. He doesn’t have
any questions when asked by the judge.

16.30 (09.30) The court hearing should begin any minute now.

16.25 (09.25) Kim Ledger, the father of the late Heath Ledger,
has warned people not to blame the Dark Knight Series for the Colorado
killing. “We can’t blame Heath or the character,” he said, referring
to his son’s portrayal of the sadistic Joker in The Dark Knight.
“It’s fictitious. I don’t know what this does to the character – I
think that’s the least of my worries. I’d be more worried about the families
and other people involved in the tragedy rather than anything else.”

16.12 (09.12) President Obama visited survivors of the massacre last
night, spending three hours talking to families and recovering victims. But
among his words of comfort there were no
hints that he was prepared to pursue new gun control laws
.

Mr Obama said he came to Aurora less as a president and more as father and
a husband. And while he called for reflection on “how we can do
something about the senseless violence that continues to mar this country”
he gave no indication that he was prepared to embark on a politically risky
push for stronger gun controls.

In a briefing before the President’s remarks, White House Press Secretary
Jay Carney said the administration would focusing on keeping guns “out
of the hands of people who should not have them under existing law”
rather than pass new legislation.

Mr Carney also said the White House would not take up the fight to renew
the ban on assault weapons which expired in 2004.

“We need to take steps that protect Second Amendment rights of the
American people but that ensure that we are not allowing weapons into the
hands of individuals who should not, by existing law, obtain those weapons,”
he said.

16.05 (09.05) As you can imagine security at the Arapahoe County
Justice Center
is tight this morning as Holmes is transferred from
Arapahoe County Jail, where he is being held away from the general prison
population. Sheriff’s deputies are stationed throughout the court and on the
roofs of adjacent buildings.

15.54 (8.54) Yesterday, Aurora police chief Dan Oates said that
the 24-year-old Holmes had “lawyered up” and was not co-operating
with authorities, despite initially warning them that his apartment was
booby-trapped. His lawyer is James O’Connor, a local public defender, who
may try to plead insanity on behalf of his client. Police have already tried
to head off that defence, noting that Holmes received dozens of packages
over several months in what they say was a “calculated and deliberate”
build up to the massacre

15.51 (8.51) We’re expecting the gunman to make only a very brief
appearance in front of an Arapahoe County judge at 9.30 am Colorado
time. He will be told the grounds on which he was arrested but will not
necessarily learn the charges against him. After the court hearing
prosecutors will have a further 72 hours to file charges.
