Another citizen is claiming that Fullerton police confiscated her camera in the wake of the Kelly Thomas beating death.

This makes at least three cameras seized from citizens whose content has yet to see the light of day.

And that’s not counting the city-owned surveillance camera that prosecutors refuse to release on the basis that it could taint witness testimony – never mind the fact that they’re already interviewed all the witnesses.

However, Kelly Thomas’ dad, the retired Orange County Sheriff’s deputy, has filed a claim that he intends to file a lawsuit, which would give him legal access to the video considering it is “evidence.”

And he’s been one of the main proponents of seeing that video released.

Meanwhile, Friends of Fullerton continue to provide the newest info on this case, including the two videos included with this story.

The top video is an interview with a witness to the incident that claimed a police officer intimidated into handing over the film from her camera.

The second video is an interview with another witness who said that police had sat Thomas on a curb for about 20 minutes and when they moved in to arrest him, he jumped up and tried to run away.

The officers quickly pounced on him and began beating him.

This case could be a rerun of the Rodney King-LAPD incident in ’91. Difference is Thomas was killed violently and the City’s videotape of that incident is being witheld on the assertion that it would ‘taint potential jurors’ but would more likely cause an riot. The probative value of the tape’s contents far outweighs the predjudicial value and the Fullerton cops meanwhile were permitted to view that same tape several times as they rewrote their reports over and over, according to an cop informant caller on KFI640 AM live radio. (See fullertonsfuture dot org to hear that entire KFI radio interview.) How can the public interest best be served when the Orange County DA’s office has former cops onboard? It cannot. In the end, the DOJ’s CRD will likely have the final say with these HGH cops in Federal court and those charges will carry longer prison sentences, just like the King case in Los Angeles federal court. Never allow the cops to intimidate you. They work for you! Remind them of that fact when they confront you. “Officer” may be their title, but “public servant” is their job description. Just stand your ground, remain calm. If they say something is illegal, ask them to quote the law that you are breaking. If you feel threatened for your personal safety, then tell them that they are dismissed, and back away until you are far enough away to walk away. NEVER RUN!!!
They don’t care if they win or loose a case all they want to do is inconvenience you. They take your camera, take you to jail that’s money out of your pocket not to mention time that you will never see again. They dont have to win in court the time you waist on there petty charges is a victory enough!
