Wisconsin man arrested for selling raw milk.
Demonstrating his ignorance of core values enshrined in common law and what Judge Cooley defined as the “right to be left alone” from overly pernicious government interference, a Circuit Court judge in Wisconsin has ruled that people who consume raw milk have no right to do so.
In response to a request from the Farm-to-Consumer Legal Defense Fund for clarification in a court case on the issue, Judge Patrick J. Fielder wrote that the “court is unwilling to declare that there is a fundamental right to consume the food of one’s choice without first being presented with significantly more developed arguments on both sides of the issue.”
According to Fielder, citizens must get permission from the state before deciding what they can or cannot eat or drink.
“Plaintiffs do not have a fundamental right to consume the milk from their own cow,” he decided, and added that “Plaintiffs do not have a fundamental right to produce and consume the foods of their choice,” not without permission from government.
Fielder underscored his belief – and the belief of the state – that an individual must gain permission from government to consume food. He wrote that only “a license holder” can sell milk and the license holder “must do so in a way that complies with the laws of Wisconsin.”

The nanny state in Wisconsin mandated that an individual does not have a right to consume raw milk after the Wisconsin Department of Health Services and the Wisconsin Department of Agriculture, Trade and Consumer Protection said individuals in the state tested positive for campylobacter jejuni, a bacterial infection, they claimed was linked to consumption of unpasteurized milk.
In response, Senate Bill 108 was introduced. It would “legalize the sale of raw milk, decriminalize innocent farmers, and allow consumers to buy the milk they choose,” explains Wisconsin Campaign for Liberty.
Fielder’s response to the argument that food consumption is a personal choice outside the purview of government represents the troubling and growing mindset of bureaucrats and politicians who believe the state has an overriding interest in individual decisions, no matter how mundane.
Recent legal action by local government around the country highlight this. In Michigan, a woman faced 93 days in jail for the crime of growing a vegetable garden on her property. After a court threw the absurd charges out, vindictive local officials came back and attempted to renew an earlier charge against the woman for having unlicensed dogs.
City bureaucrats have gone to extraordinary lengths to make sure residents – more akin these days to subjects and vassals – are not allowed to grow their own food.
In Oklahoma in 2009, a city councilman said during debate on outlawing community gardens: “How do we know what people are going to be growing? Vegetables? Maybe. Or, maybe something else,” he said. “Is there going to be someone that inspects what is growing?” Tulsa city council bureaucrat Jack Henderson alluded to residents growing marijuana in order to make his argument that the city should inspect gardens.
Running afoul of state and its wilderness of rules and regulations is now drearily common, if not outrageous. In August, police shut down a lemonade stand operated by a 4-year old in Coralville, Iowa, because the girl did not apply for a health inspection and pay for a permit.
Massachusetts followed suit when state police closed down a green-tea stand operated by a 12-year old.
Woman fined $500 for allowing her kids to run a lemonade stand.
The inexplicable and growing effort by cities and states to close down lemonade stands is a growing phenomenon that demonstrates the determination of over-bearing government to regulate – and license and revenue-generate – all aspects of daily life, even the most mundane and harmless.
Fielder’s assertion that citizen-vassals do not have a fundamental right to decide what they consume without first gaining permission from an over-bearing government is a strike against the core values of liberty and self-reliance enshrined in the Constitution, the Bill of Rights and the Declaration of Independence.

Suggestion:
It would be great if there was a permanent, VERY noticable rectangle on your home page where people could go to post only protest/movement ideas. It needs to be separate from the reporting area (perhaps right next to it) You guys do such a great job of reporting what’s happening globally, and many individuals write posts with great ideas for peaceful protests in response to your articles. Understandably, these articles need to be fluid and get moved into archives so new articles can come in. But these great ideas for protests get moved with them, and they don’t get a chance to build up any momentum. We may have lost some really good solutions this way, and solutions are why we’re all doing this… its what this is all about right? There are so many of your listeners that want to get a good protest idea to the masses, or wish they could take part in something that is going on currently, but don’t know where to start. So I’m requesting a permanent location on the home page for ONLY protest ideas to be posted, where anyone can go, at any time of day and post their idea or look for an idea they can take part in. Any one care to second my request?

The system doesn’t serve your interest because it is too busy serving special interest. Do you care? Wake up to these facts and realize that you must act if you want to go beyond the status quoi. There are those that are still asleep and convinced in their beliefs that modern times don’t require a more reasonable and fitting form of control over government. They believe that the system for what may have worked for the government over a hundred years ago can’t be improved upon. They are wrong! It is inherently systemic in the process for government to be easily, continually and totally gamed by special interest. Yet, this can be changed and improved but it must be done systematically if the improvements are to last and not be subverted again and again by special interest! Actions speak louder than words. It is now time for action! If you are willing to take action read on?
Presently, elected officials votes reflect at least one of three possibilities: their interest, some other (special) interest or the interest of their constituents. The problem comes when elected officials don’t reflect the interest of the majority of their constituents with their votes. Yet, most elected officials are just smart enough to get elected while saying they will vote for their constituents interest. Well, most people no longer trust their words on this.
Isn’t it time that you participate directly in government concerning your own interest. No, not as a politician, but as a constituent of your elected officials. If you were to participate directly in government in this capacity you might find that yours and most other people’s interest are the same most of the time. Together, in this capacity you might find that great positive changes can be accomplished.
There is a modern-day equivalent of the movement that added the Bill of Rights to the Constitution. It is a political movement that will make local, state and national government, more transparent, less corrupt, more accountable, less wasteful, more fair and just. That political movement is “The People’s Branch” at ThePeoplesBranch(dot)org. The People’s Branch is a realistic, reasonable and non-violent, way for the people to regain control of government from special interest.
The People’s Branch is working to create an additional check and balance upon each elected official by giving their constituents the power to directly participate in the governing process alongside their elected officials. It works like this. Presently, elected officials exercise their vote regardless of their constituent’s interests. However, with The People’s Branch, the change comes when legislation is finished and the elected officials have voted. i.e. The job to implement and start legislation remains with elected officials. Presently, elected officials see the need for or are persuaded (by their constituents or some other (special) interest) to create legislation regarding some matter. Then the other elected officials either see the need or are persuaded (by their constituents or some other (special) interest) to vote one way or another on that legislation. Whither or not any particular legislation serves some constituents interest or some other (special) interest is always debatable.
More to the point, with The People’s Branch each elected official’s vote concerning a legislative matter may remain the same or be changed by a majority vote by their constituents. Constituent voting is voluntary and may be exercised by electronic means from home or office. Constituents only vote on their own elected official’s vote. Constituents may only vote to approve or disapprove said officials vote. Only when the majority vote of the constituents approve their elected official’s vote does their vote remain unchanged. Otherwise, if the majority vote of said constituents disapprove the elected official’s vote then said official’s vote is altered to reflect the position of the majority of the constituents. In this way, the constituents are the ultimate check and balance for their own elected officials.
The technology now exists that can implement this process. Implementing a “People’s Branch” at each level of government, local, state and national, will virtually guarantee a government that is more transparent, less corrupt, more accountable, less wasteful, more fair and equitable. Politicians fear this political movement because they know that if it succeeds then their power and control will come to an end and the people’s influence upon government will truly begin.
There has never been a greater need for the political solution(s) provided by The People’s Branch. But no one is saying it is going to be easy. Yet, neither was the Civil Rights movement or the Women’s Suffrage movement, etc., etc. So, why is it that even though everyone is for better government, a political movement that would ultimately improve government at all levels by neutralizing special interest’s control is yet to be implemented? It hasn’t happened yet because you haven’t made it happen. When things get bad enough you will be willing to make it happen then. Why wait and go through that pain when the needed changes can be done now. Why not save yourself and a lot of people a lot of pan and hardship?
Again, take action and get involved with the most likely political solution that has a chance to truly reform the evils of government in a sustainable way! You can help make this political movement a service to everyone. Start a petition drive. You, your family and future generations will be grateful for the positive changes.

Im very thankful here in NY that i havent seen any of this kind thing.
We have an open farmers market one or two days a week.
Many in my community and in the outlieing areas have gardens.
It is everyday day here. up north of me there are roadside stands that still have the honor system instead of someone there all day.
Whats going on around the country is not happening here.
oh yeah we have some of those. needless to say, people weren’t being very “honorable.” places were being broken into all over.
The state is equal to or worse than the federal government. It would be better to break into small countries than continue on the path of states rights.

I run MemphisHistory.com. I’m also the author of Memphis Then and Now. I’ve researched the “milk problem” that occurred here in Memphis in the 40s and 50s. The problem was that people didn’t tend to wash the milk pails. Sometimes they were so caked that strongly impacted the volume. Homogenization of the milk, my mother assures me, was a great step because the milk wasn’t constantly separating. Pasteurization (boiling the milk) was not and is not a fix for the problem which was a lack of hygiene.

I always laugh when I hear a newscast or read that they are giving to charities… how many truly charitable people do you think accumulate 10 Million+ without hitting the lottery? Here’s a hint… NONE!
How many of our “leaders” (Hillary, Liebermann, etc) or “captains of industry” (CEO’s – Goldman SACHS, BOA, etc) do you think have pumped their own gas or drove their own car? Do you think they do their own grocery shopping or cook for themselves? Do you think they clean their own home or make their own beds? Do you think they would enjoy camping or fishing? Or anything normal people do for that matter?
The point I’m trying make is this… most of the people we now call “leaders” or “captains of industry” have been exploiting others for so long that they can’t take care of themselves let alone do what’s right or know what’s best for the rest of us.
We also have “leaders” and “captains of industry” that are “narcissistic sociopaths” and participate in eugenics and profit from misery and death, these people are evil by anyone’s definition… except their own… because they think they have their God’s blessing.
It is my hope that our military and law enforcement agencies wake up soon and hunt down all the leaders involved in this particular group. Personally, I’d have this group beheaded… I’d encase their heads in glass pyramids (since they have such a fondness for them
