Twenty-two of Justice Malo’s colleagues have requested that he step down. Malo refused, but agreed to withdraw from pending investigations into two Senators who allegedly bribed him. Justice Gustavo Malo is in the thick of the biggest judicial crisis in Colombia in recent history.

The word banana republic comes to mind; Even though, some would interpreted the fact that Malo was asked to step down as a step in the right direction – out from the shadows underneath the banana trees and into the light.

The office of Colombia’s Prosecutor General investigates the bribery cases involving the two Senators who allegedly paid Malo. The Prosecutor and Congress are also investigating the activities of Malo’s daughter who allegedly has charged officials for jobs given to them with the help of her father, Supreme Court Justice Gustavo Malo.

Critics of Malo and Congress stress the irony of the facts that “Malo deemed himself uncorrupted enough to stay” even though 22 colleagues asked him to step down; Not to forget the fact that Congress – generally deemed as one of Colombia’s most corrupt institutions – decided to investigate the scandal.

bananaBut then again, some say, that one should be careful not to violate the principle of the presumption of innocence. Especially not when one wants to clean house at the Supreme Court in a banana republic in which part of the ruling oligarchy aspires to make improvements; That is, of course, as long such “improvements” don’t affect them directly and negatively.

Justice Malo and Justices Leonidas Bustos and Francisco Ricaurte are facing charges of having received “compensation” to rule favorably in the cases of multiple congressmen accused either of “parapolitics” or corruption.

The case against the three is one of multiple that were launched after the arrest of the prosecution’s anti-corruption chief, who allegedly mediated between the lawmakers and the court officials.

Top prosecutor Gustavo Moreno was arrested in June 2017 after the United States Drug Enforcement Agency warned his immediate superior, Prosecutor General Nestor Humberto Martinez, about the top official’s alleged corruption.

The DEA wants Moreno to appear before an American judge as at least one of the bribes – allegedly – took place on U.S-American soil.

The involvement of the United States and the DEA are of course sparking additional controversy and who would be surprised. For readers who are still naive about the DEA and its activities in Colombia, here’s just one example.

In 2015 it transpired that the DEA was accused of such noble activities in Colombia as allegedly drug-funded sex parties with Colombian prostitutes – not to even mention child sex abuse and sex abuse scandals involving U.S. troops and military “contractors” in Colombia; Yes, yes, there’s plenty of room for banana plantations in the United States.
