Boy, 13, charged in alleged bullying case of boy who committed suicide is acquitted

OSHAWA, Ont. – A 13-year-old boy charged with robbing and assaulting an 11-year-old who later committed suicide has been found not guilty.

The accused boy was acquitted today in Oshawa, Ont., on charges of assault causing bodily harm and robbery.

Police had alleged the suspect slammed Mitchell Wilson‘s face into the sidewalk and stole his iPhone in Pickering in November 2010.

Wilson, who suffered from muscular dystrophy, killed himself last September, the day he was subpoenaed to testify in the case.

His parents have said he was being bullied.

The judge says the Crown could not prove beyond a reasonable doubt that the accused was the one who attacked Wilson. (CFRB, The Canadian Press)
