Gary McKinnon has refused to undergo further medical tests to determine if he is fit to be extradited.

Home Secretary Theresa May has asked the Asperger’s sufferer, wanted by the US for hacking into Nasa and Pentagon computers, to undergo a psychiatric assessment by a government-appointed expert before making a decision on his fate.

But his family say he has been assessed on ‘at least six different occasions by six independent experts’ and claim Home Office-appointed Professor Thomas Fahy has no experience in uncovering suicidal tendencies in Asperger’s patients.

Doctors have already said Mr McKinnon, 46, may attempt suicide if he is sent to the US, where he faces a jail sentence of up to 60 years. Explaining his decision to decline a new test his mother, Janis Sharp, said: ‘The assessment they want him to have is by someone who has no experience and wouldn’t be able to diagnose his suicide risk.’

The case, which has dragged on for more than a decade, returns to the High Court next week ‘in anticipation of an imminent Home Office decision’, his family said.

At a court hearing this month, judges were told Mrs May was ‘close’ to making a decision. But she was ‘concerned’ that medical experts instructed by her department had been unable to carry out an examination to help her decide whether Mr McKinnon would be at high risk of committing suicide.

Mrs Sharp said: ‘Gary’s ordeal has gone on far too long. The Home Office should accept the very clear and incontrovertible evidence provided by the country’s leading psychiatric experts in this field.

‘It’s time to make the right decision and end Gary’s torment of extradition. When he’s fit and ready, as we have said all along, the Crown Prosecution Service could try him in this country for his foolish acts that happened over a decade ago.’ Mr McKinnon’s fight, backed by the Daily Mail’s An Affront to British Justice campaign, has exposed the controversial US/UK extradition treaty, which critics say is lopsided and unfair on Britons.

Home Office figures released last month revealed that seven times more British citizens have been sent to the US under the treaty than there have been Americans sent in the opposite direction.

An adviser to the US government on cyber warfare has attacked America’s ‘ridiculous’ and ‘punitive’ attempt to extradite Mr McKinnon. John Arquilla said officials should instead be hiring Mr McKinnon to help them improve security.

Mrs Sharp said: ‘No one has ever been extradited from America to the UK for conduct that took place in America so why is Britain extraditing British citizens to the US for actions undertaken on British soil?

‘It’s cruel, unnecessary, and for years has blighted not just Gary’s life but mine and our family’s too.

‘Parliament passed a motion in December for treaty change to take place as pledged pre-election by the Coalition. Hopefully this will be implemented soon.’

A Home Office spokesman said: ‘The Home Secretary will make a decision as soon as possible. It is a complex case in a complex area of the law, and a large amount of material has been submitted.’

What this lad did was illegal and as such he should answer to a court of law…….BUT in the UK only. The crime was commited on UK soil and this USA/UK deal only seems to work one way, in the Americans favour!

Strange this chap gets Aspergers when he knows he knows he’ll be deported. Just take the damn test and abide by the results. Stop whinging and pretending you were looking for Aliens.

Of course he refused .. he doesn’t want to be found out. Just put him on a plane and get rid .. and charge him for all this time wasting

Are all the TESTS that he has had NOT good enough for HER then .—- She will never decide anything about him NO matter what results are got.—-She has NOT got the GUTS for it,—- Just like the deporting of those TWO unwanted that she was all of a sudden going to have Deported.— We have not heard ANYTHING lately have we.——- They are STILL here scrounging and likely to be well after Christmas and beyond.— IF she does send him to America THIS will prove that she is USELESS and IF he does commit suicide .– IT WILL BE ALL DOWN TO HER

The only thing that should now happen with Gary McKinnon is that he should be escorted to Heathrow and handed over to US authorities and sent to America for trial. Considering what he did in what he hacked into the military systems and even more importantly what he might have done had he not been stopped does not bear thinking about. This feeble and continual excuse of suicide is yet another red herring. He would be as safe and as well looked after as he is in his own home in America. If Teresa May orders his deportation it will at least one thing she has got right as Home Secretary.

Does the government appointed expert belong to ATOS? They don’t recognise mental disorders, in fact they don’t recognise many physical ones either.

Lots of suspects are at risk of suicide. Guess you can do what you like and then find a doctor who says you might be suicidal if you have to face the consquences of your actions-would anyone get to trial.
Also does having a diagnosis of asperegers mean you can do what you like and get away with it.
