Hospital Refuses Tubal Ligation Because of Catholic Religion

The American Civil Liberties Union (ACLU) has filed a lawsuit again Dignity Health (DH) on behalf of Physicians for Reproductive Health (PRH) and Rebecca Chamorro for refusing to perform a tubal ligation at Mercy Medical Center (MMC).

Chamorro was scheduled for a cesarean section in January of 2015 and requested a permanent form of contraceptive. MMC denied Chamorro the procedure because the hospital adheres to Catholic mandates against the preventative surgery.

Elizabeth Gill, senior staff attorney for the ACLU explained that “it’s an incredibly common procedure used by a significant number of married women, but it’s being denied based on religious doctrine.”

Chamorro is a patient of Dr. Samuel Van Kirk, an OBGYN who delivers babies at MMC. Kirk is also a member of PRH, a national nonprofit organization with an estimated 1,200 members that advocates for access to maternal care.

Kirk stated in the complaint that 50 of his patients over the better part of a decade have been refused tubal ligation post-partum because of MMC’s “allegiance to Catholic doctrine”.

In response, DH said in a prepared statement : that it is the hospital’s “practice not to provide sterilization services at Dignity Health’s Catholic facilities,” in accordance with guidelines issued by the U.S. Conference of Catholic Bishops, which state that Catholic health care organizations are not permitted to engage in actions that are “intrinsically immoral,” including sterilization for men (vasectomies) or women (tubal ligations).”

This is not the first time Catholic ideology has come between a patient and proper medical care and the ACLU has stepped in to help.

In September of 2015, Jessica Mann had a brain tumor and chose to have her fallopian tubes tied to prevent another pregnancy because of health reasons; however the Catholic-run Genesys Regional Medical Center refused to perform the surgery because they do not condone sterilization.

Mann’s physician has warned her not to get pregnant again because of the brain tumor.

The condition in question is called pilocytic astrocytoma and it develops in childhood and usually does not spread to other areas.

On behalf of Mann, the ACLU filed a suit against Genesys for not preforming the procedure is a direct risk to Mann’s health.

Officials at Genesys said Mann is no acceptation to their rules, regardless of her medical condition.

According to the Catholic Church’s teachings , sterilization and other forms of birth control are sinful because they “deliberately sabotage the procreative aspect of human sexuality and violate God’s law.”

The Catholic Church refuses to cooperate with in vitro fertilization and abortion based on biblical doctrine.
