Awake Goy David Collie was not the man they were looking for, but the Fort Worth police officer shot him anyway, claiming Collie had turned toward them with an object in his hand, making them fear for their lives.
The object, they claimed in their reports, was a box cutter, which they say was found 10 feet from Collie after he was shot.
But a dash cam video released Tuesday shows Collie did not turn toward them nor did he appear to have an object in his hand.
The video, in fact, shows they barely gave him a chance to do anything as they pulled up to him in the apartment complex two blocks from the gas station where the armed robbery supposedly took place.
If anything, Collie looked as if he were pointing in front of him, maybe pointing to his apartment to justify why he would be in the area. The video contains no audio, so it’s not clear if that was deliberately removed or it just didn’t record audio, which would defeat the purpose of having the dash cam.
And although police acknowledged he was not the robbery suspect, Fort Worth police charged him with aggravated assault on a public servant to justify shooting him.
But a grand jury chose not to indict him based on the video, according to the Fort Worth Star-Telegram.
However, there is still no word on whether the cop who shot him, only known as “Officer Barron,” will face charges.
Police claim the shooting is still under internal investigation, even though it took place on July 28, 2016.
Barron, a Fort Worth cop, was with a Tarrant County sheriff’s deputy that night. Both were said to be off-duty, which generally means they were hired as private security, but there has been no confirmation on that. All we know is that they were working an “off-duty assignment.”
Collie, 33, who ended up spending 61 days in the hospital handcuffed to a bed, is now paralyzed from the waist down.
His attorney, Nate Washington, said he released the video after seeing the video from last week showing a Fort Worth cop arresting a mother and her daughter after the mother called police for help when a neighbor assaulted her seven-year-old son for littering.
