Cheyenne police take first forced blood draw

CHEYENNE — Cheyenne police are believed to be the first in the state to forcibly take a person’s blood via court order under the state’s new DUI law.

Statutes changed July 1, allowing officers to obtain a search warrant to take a suspected intoxicated driver’s blood if he or she refuses to willingly provide a sample.

Prior to the change, warrants were only obtained for individuals involved in crashes with serious injury or fatality.

“Usually, once we have the warrant they go ahead and cooperate with the blood draw,” Chief Brian Kozak said. “This is the first individual who refused to cooperate and had to be restrained.”

  1. Have no fear folks, these guys know what they are doing, and don’t think for a second that they would mistakenly force your wife, on the side of the road some night, to succum to a forced blood draw sample. God help the poor little worm

  6. Is this article some kind of joke? There’s only like maybe three people who live in Wyoming anyway. We as Americans have become nothing but a punching bag, let me get this straight, if a American has a beer after work and heads home he can be stopped strapped down and blood tested, but a fucking Mexican can enter our country illegally with complete support of our goverment. Am I missing something?

    • It’s already being taken allover the U.S. just has not been forced. It has been willingly taken just like a breath-alyzer.

      As for the Mexican deal….. Yes, that is the plan to DESTROY the U.S..

  7. How does a warrant apply inside your body?
    What probable cause would they even have?
    Court order, what subject matter jurisdiction?

  8. Because of medicinal marijuana and other pharmaceuticals it is in their best interest to start a blood taking campaign.$$$$$$$$$$$$$$

    There is a lot of money to be made off of the people as the lawyers, judges, jails, prisons and probationary mandates stay busy.

    Its all big business as usual.

    • One of the “big” deals with this is that Mari Jane stays in your blood for 30 days or more, SO, you may not have smoked for a month but you WILL be charged “under the influence” anyway!

  9. Those needles are razor blade sharp and can slice an artery wide open if the person does not do it properly or if the subject is moving. Any lateral movement risks serious injury. Also if the needle is inserted too far it can pass through the opposite wall and damage nerves.

    Too often experienced nurses fail to draw correctly how are cops struggling with an unwilling person going to do it right? This is totally unnecessary if they fail a field test that has not stopped them from charging with DUI in the past. This is more conditioning of both law enforcement and the general public.

  12. If he fail the sobriey test then why forcefully take blood? What’s the point he failed he’s going to jail period! All this is one more law that does not do anything more to protect anyone. Just to take more power!!! Well get the state more money.

  13. I wonder how many tomatoes they practice on to hone their skills, I would think they would need a ‘Medical License’ with a least two years of school with students loan to pay for their new career.

    Void your contract or at least reserve your rights, without prejudice 1-207 ud, it is all contract because ‘they use play money’ and for pete sake do not claim you are a US citizen. Use your state as your country and nationality. Let the pigs play in mud.
