In a recent column appearing on InfoWars.com, Kurt Nimmo succinctly and correctly pointed out that the federal government’s usurpation of State sovereignty, jurisdiction, and authority is worsening. The current case in point is the recent open letter to all firearms dealers by the ATF. Nimmo begins, “In its continuing effort to pare down the number of Americans who can exercise their rights under the Constitution and the Bill of Rights, the Bureau of Alcohol, Tobacco and Firearms has sent a letter to firearms dealers informing them that medical patients ‘addicted’ to legally dispensed medical marijuana have no right to own and possess firearms.

“According to Arthur Herbert, Assistant Director of Enforcement Programs and Services at the ATF, ‘any person who uses or is addicted to marijuana, regardless of whether his or her State has passed legislation authorizing marijuana use of medicinal purposes, is an unlawful user or addicted to a controlled substance, and is prohibited by Federal law from possessing firearms or ammunition’ and will be compelled to admit the prescribed use of medical marijuana on ATF forms at the point of purchase.”

Nimmo goes on to point out, “More significantly, the ATF’s move to deny cancer and other patients medical marijuana is part of a larger attempt to roll back the Second Amendment by color of law and also attack states’ rights as guaranteed by the Tenth Amendment.”

And it’s not just medical marijuana and cancer patients that the ATF–and its water boys in Congress–wants to deny Second Amendment rights to. As has been previously reported, many of our nation’s veterans are also on the “hit list” as not eligible to keep and bear arms.

Beyond that, any person who has been diagnosed with a “mental disorder” is also in the cross hairs for having their Second Amendment rights expunged. And, of course, “mental disorder” could include anyone from a returning combat veteran who suffers from “post-traumatic stress disorder,” or “combat fatigue,” to someone who was prescribed medication for Attention Deficit Disorder (ADD) as a child, to someone who was diagnosed as suffering from bipolar disorder. In other words, the federal government wants the power to classify just about anyone it wants to as having a “mental disorder” and, therefore, be denied their right to keep and bear arms.

But there is even more. Nimmo writes, “In 2009, Democrat and notorious gun-grabber Rep. Carolyn McCarthy introduced The No Fly, No Buy Act (H.R. 2401), a bill that would have merged the TSA’s no-fly list with the National Instant Criminal Background Check System (NICS), a point-of-sale system for determining eligibility to purchase a firearm.

“The current mayor of Chicago–the largest anti-Second Amendment city in the country after New York City–and former Obama Chief of Staff Rahm Emmanuel proposed that anybody on the fed’s no-fly list (numbering in the tens of thousands) should have their Second Amendment stripped.”

Of course, if having one’s name on the no-fly list makes one a terrorist, why wasn’t former senator Ted Kennedy so identified? It is a matter of public record that he was detained several times by TSA agents, because his name kept showing up on the no-fly list.

Nimmo concludes his column by saying, “The feds are determined to whittle away at the Second Amendment and this under-handed effort to make gun dealers responsible for determining if their customers are marijuana ‘addicts’–under penalty of losing their licenses–is part of the long term plan to disarm the American people.”

This draconian decision by the ATF hits people in my home State of Montana especially hard. Under the laws of the State of Montana, a person is lawfully allowed to receive prescribed amounts of medical marijuana for legitimate health reasons (I know many of these people personally). And contrary to what anyone inside the Beltway says, marijuana in medicinal amounts has been proven to greatly assist people who suffer from a variety of maladies. Furthermore, the misuse of alcohol–which is also known to help treat a variety of illnesses in medicinal amounts, which even the Holy Scripture collaborates in I Timothy 5:23–inflicts far greater havoc upon both the individual user and society in general than marijuana has or could ever inflict.

It is also true that the so-called “war on drugs” by the federal government is not only an abject failure, it has become a tool by which power-hungry despot-wannabes strip hundreds of thousands of harmless, peaceful Americans of their freedoms and liberties. There are tens of thousands of people languishing behind prison walls that have never harmed a single person, have never stolen, have never committed an act of violence, or have never even shown the slightest aggression toward a fellow human being. They languish for decades and even for a lifetime in harsh prison conditions because of this never-ending, always escalating “war on drugs.”

Talk about a financial cost to taxpayers: the cost of incarcerating tens and hundreds of thousands of harmless, nonviolent drug users–not to mention the cost of investigating, arresting, arraigning, and trying them–literally dwarfs whatever the cost would be to let them live peacefully in society, or even to allow churches and special-needs ministries and hospitals to treat them.

But a few things the “war on drugs” does accomplish is it serves as a major reason to increase federal funding for all kinds of Gestapo-like tactics at every level of government; it provides justification for governmental restrictions of civil liberties; and it is a major excuse for the exponential growth of the emerging police state. And dare I even mention the fact that it is now absolutely certain that persons (at the highest levels) and agencies within the federal government have been (and are) reaping gargantuan profits via illegal drug trafficking. As one retired federal agent (that’s right, federal agent) who was personally involved in the feds’ “war on drugs” for decades personally told me, “Chuck, the federal government hates competition.” (I’m not making it up; that’s what he said.) Oh yes! It also allows the ATF to deny Second Amendment rights to more and more people!

America desperately needs State governors to draw a line in the sand against this federal leviathan for the protection of the liberties and freedoms of the citizens within his or her State! Let me say it bluntly: we desperately need a State governors to tell the feds to go to Hades! If State leaders would stop cooperating with and submitting to these would-be tyrants, I am convinced the people of the states would rally behind them in record numbers and speed! I am absolutely convinced that this would be the case in the Mountain States anyway. And when the feds attempt to withhold federal tax dollars from these courageous, albeit recalcitrant states, it needs to be remembered that the states can do likewise. They can withhold tax revenues from the feds: two can play that game! All it would take would be a plucky governor with enough backbone to do it!

In the meantime, combat veterans, people who have taken certain prescription drugs, people who have shown up on no-fly lists, and now people who have been lawfully issued a particular medical card can be denied their right to keep and bear arms by the US government. When will the American people ever have enough?

  1. It’s over. The United States is the most divided nation. You cannot have nationalism with a bunch of cowboys. 9 out of 10 times John Maclane gets killed by Hans Gruber within 10 minutes. They really need to reshoot Die Hard. John Maclane loses 10 out of 10 times when he takes on Hans and Simon Gruber. The villains are the real heroes. We don’t need Mr. Fantastic when you have Dr. Doom. He is incorruptible. To be a survivor you have to suffer. John Wayne would get his ass handed to him by the legion of doom. Batgirl would make quick work of John Wayne.

    I am trying to figure out a game that will handicap the world. I cannot put into words how messed up this world has become. Life is a joke. Tomorrow is a new day and the nightmare will continue.

  3. Our freedoms are what make us American. States need to exercise there right to nullify those laws which violate our constitutional rights.

  4. People seem to me as though they believe they have no authority in matters of State and local control and governance. If people believe they live in a hell hole, and lead boring lives, and are stressed out because they have no job, then they need to correct this matter and create their own jobs, get involved in more local issues, and trasform their hell holes into more enjoyable enviroments. Maybe then they will understand just how much rights and control they have.

    The state in fact has the sole authority in delegating the concerns and respective rights of the natural-born, US citizens, and entitlements that are in fact guaranteed by the US Constitution.

    Back handed and double-dealing with interstate trade agreement with health care is illegal., and borrowing from 401k, pensions, and other federal programs is a violation of interstate commerce, and it duly and wrongly imposes upon the states delegations to represent the people under its laws.

    Miraculously raises $ 70 Million Dollars in one day to aid his campaign, for re-election without exposing his resources, and revision can be over ruled by the US Supreme Court Article VI 6, *sect 26 the old laws applied, when under the review of the court to try such matters, that in fact put the whole constitution in jeopardy, and such misrepresentation by the interpretation of the laws could pernematley erode these right to the people.

    The allowance of such activities is strictly a violation of the laws and its ENTIRE Doctrine, and the US Constitution, and other serious offences committed by the Obama Administration.

    I saw the headline and came to write “of course there aren’t rights! Look at marijuana regulations and state leniency….” but I saw a weed photo so I guess I don’t need to bring it up.

    What’s my point this post?….um, I guess what I’m getting at is that many people RESPECT weed as the medicine and industry and peaceful revolution that it is, so its resistance by the zio-nazi feds will only make people turn against the status quo owners….at least on some level. And the last two generations….that’s a lot of people.

    Weed is teaching and helping humanity, and it can’t be reversed without draconian enforcments and extreme violence (not that there isn’t plenty already).

  13. State Nullification of unconstitutional law is the last check on the Federal Government.

    The large majority of people believe the last check on unconstitutional laws is the Supreme Court.

    But using common sense, one quickly sees the flaw in this reasoning.

    How can the Supreme Court police the Executive and Legislative Branch effectively when the three are all parts the Federal Government?

  16. The misinterpretation of “General Welfare” is behind the behemoth growth of the Federal Govt. As part of the process of passing bills that go beyond its enumerated constitutional power, congress now cites the General Welfare clause as their authority.

    The Founders intended “General Welfare” to be used to determine if a bill seeking to exercise their enumerated powers was in the interests of the general welfare.

Hydrogen fuel cells cost 7000 per cylinder but thats how the rich run their cars on water. Seriously, we dont have to have BIG CORPORATIONS destroying our ecosystems.

Ask the families of those whose kids were told that if they don’t work for the drug lords, who make huge profits from the sale of it on the AMERICAN MARKET, that their family members will be sold as sex slaves, or made involuntary organ donors, or killed outright!   19. The time has come and the 2012 election will be too late. the power lies with the States. The States vest the power to the Fed and as soon as a smart group of Governors realizes the Power within their grasp we can turn back the political clock a hundred years. Texas, South Carolina and Arizona recall their reps from D.C, freeze all Federal regulation and tax collection and see how long it takes a dozen more States to join. At that ponit most of D.C. will have the sudden realazation that they are living in Rental Housing and the Credit Card has been canceled. The movement begins with the States..The power was theirs before and it can be again.

    • However, the power of the States comes from the PEOPLE in it. It’s up to the people to force their States to take the power back. Remember, the people pay taxes to the Counties, States, federal. The Counties pay taxes to the State and Federal. The State payes taxes to the Federal. The Federal pays the Union dues to the Federal Reserve Corporation to pay off the Union deficiet.

      The American Union of the United States of America, is simply an organization put forth via the Federal Reserve Corporation to govern the States as a group of Union members. It was never ment or intended to be a form of national government like a country has to govern them. However, over time, the American people have come to look at it and even call it a national government.

      The ONLY National Governments there is, are the State Governments, because the States are actually Countries. The 52 countries are only referred to as States, as each State is a MEMBER of a “UNION”, that pays Union dues, called taxes. Just like a worker that is a member of a Union, paying their union dues. They can both resign at any time. All the people in EVERY State pays taxes. That is to say, they are ALL paying Union dues to a Union that the are a member of, weather they wanted it or not. Remember, America is not a country, it’s a Corporation. An extention of the Virginia Corporation the British Crown Chartered back in the 1400′s.

      America is the name of the Virginia Corporations’ colonial Union. You people are paying Union tax dues to a Union you never realized your part of, and never agreed to join. So, why do people pay taxes to a Union they didn’t request to join up too? The problems your State or Countries are facing is caused by a Rouge Union that has become tyrannical, and is using YOUR tax money to do it, stomping all over your State/National Governments ass’es.

  21. I agree this is just another way to DISARM Americans but lets be fair here. The STATES are the BIGGEST problem because THEY have given their power to the Feds, which they do not even have the authority to do.

    We will never be able to stop the Feds until we FORCE our STATES to TAKE their power back and actually USE IT to STOP the Feds!

    It is time to get rid of EVERY single governor, mayor, councilman, senator etc and put a whole new batch in there. NO career politicians, no SELL OUTS, no Bush, Obama, Clinton, Regan lovers.     • The 68 Gun Control Act is another one of these emergency laws. The Congress found that gun crimes were out of control and the whole union was threatened with anarchy unless they acted. They stated that the States had failed to address the problem of gun crimes and they needed to intervene. Additionally, the feds were empowered to intervene only in States that didn’t have a minimum amount of gun control legislation. So why do the feds think that they have a blank slat to run riot in every State when any State that has at least the same statutes as the federal statutes is exempt from the 68 Gun Control Act.

    • Problem with your “SOLUTION” is that you forget one thing. PEOPLE hate people. Just like anyone that gets promoted up in a corporation, their new found authority goes right to the head. Then they see the money, and that’s it. They forget the people they leave behind in sociaty. It’s not the people that need to be changed. It’s the SYSTEM and the MONEY that FUELS it that needs to be changes.

      You can change a bus driver all day long, that doesn’t change the bus route or how the bus is driven. Only changing the bus or the fuel it runs on can change anything about how the sevice is provided.

    Is Coffee a controlled substance??

    I mean , isn’t everything legally sold in America under some sort of control mechanism. For safety reasons, or FDA reasons, or something.

    We have Laws that regulate the sale and purchase of all kinds of substances, by that definition, is that not a controlled substance.

    If its legal to sell and by a substance , thats the control. To place a distinction on what is addictive or not by legal use and purchase , is way out of the jurisdiction of the ATF.
    The Police State is loosing its grip , or trying to expand and tighten it.

    The legal purchase of these control substances does not Prohibit me from buying a firearm, why should the state sanctioned legal purchase of pot be any different.

    So , why is it any different for legal pot users.
    Take this argument to the supreme court,the constitutional States rights will win. Assuming the Supreme court actually does its job, and that is to protect the constitutional rights of States.

    This is a requirement that the US Federal Judge, and several states can, legally declare, to make certain, that it in fact doesn’t involve -Pyramid Schemes and other tainted funding; outside the United States in off shore accounts; and that the intention is solely meant for the campaign; and all funding must be disclosed in reference to abided, without any such violations that are required, by all state and federal laws, and does not interference with the judiciary process; that the funding can be frozen; or that it’s campaign funding was not obtained legally.

    • The Federal U.S. Supreme Court does not work for, nor is it a part of, the People. It is part of and works for the FEDERAL UNION. It does what ever the Federal UNION tells them to do. The Federal Union is their boss.

      State Supreme Courts do what ever the States tell them to do. The “State”, is their boss. State and Federal is two different creatures. Union Rules and State laws are two differnent issues. Unions DON’T have “Laws”. They have “RULES”. ONLY States have laws. Just like Counties. Counties have ordinances, and they can not be enforced like State mandated laws. The Federal Corporation Union elected President is passing “Rules” like a dictator passing laws.

      Executive orders is not laws. They are nothing more then some one in a higher Corporate office issuing instructioons to the lower corporate employees to follow. The Lower Corporate employees are trying to carry them out like as if they are State mandated laws under the guise of due process (Company policy).

Why afriad? because if they apply the power that you speak of, then those in office will lose their own personal world of financial authority and finance they have right now that is gotten from having the office they hold.

      Right now, they have Washington D.C. backing them. If they start to stand up and fight for the people of their respective States, then they will lose their backng from Washington D.C.

      So, it’s not that our State reps DON’T have power, it’s they refuse to use their power.

    • Excellent observation! All of the permits that we are supposed to apply for are merely asking for permission to exercise our rights as sovereign human beings.

      I recently moved back to Massachusetts from Colorado where I carried every day. Here, it’s a “may-issue” situation where I will have to beg for the privilege to get a permit for CCW. My concern is that I will then become an easy target for the police state, even more than I was in Colorado. It’s appalling how ignorant and sheep-like these people have become.

    • It’s not Obama that is arresting people, that’s why he was able to say that without lieing. It’s the F.B.I. that is doing all the illegal invasions into States/countries and arresting them with S.W.A.T. Units. And the States have to supporting this else the F.B.I. would not be able to carry this kind of operations out on the States/nations people.

Smoking weed for medical purposes was a way around the laws that made it ILLEGAL to posses and use. Did this stop some humans from using it? Not at all! Making EVERYTHING that a human being wants to do LEGAL doesn’t mean that EVERYTHING is right and beneficial to do. Am I getting through? Its an established fact that drinking alcoholic beverages and smoking, as one example among many, is DANGEROUS to your health and could lead to various diseases like CANCER. Hmmmm? Why has the CANCER rate gone through the roof over the years? Could it be that the consumption of these substances really is DANGEROUS? The logic and reason of carnal humanity is INSANITY!
