For Earth Day NY Tells Fossil Fuels Industry: No More Fracking

In New York, the state coalition against hydraulic fracturing known as Frack Action (FA) is excited that the Department of Environmental Conservation (DEC) has rejected the Constitutional Pipeline project by quashing Section 401 of the Water Quality Certification.

The DEC explained that this pipeline project “fails to meet New York State’s water quality standards.”

John Ferguson, permit administrator for the DEC said : “[The project application] fails in a meaningful way to address the significant water resource impacts that could occur from this project and has failed to provide sufficient information to demonstrate compliance with (state) water quality standards.”

Susanne.Posel-Headline.News.Official- ny.pipeline.constitution.dec.reject.cuomo.earth.day.mark.ruffalo.01_occupycorporatismGovernor Andrew Cuomo decided to reject this pipeline on Earth Day which sent a clear message to the fossil fuels industry: “New Yorkers’ health and safety will not be sacrificed for fossil fuel industry profits.”

Constitutional Pipeline reacted in a public statement , citing disappointment in the DEC, but standing firm on their commitment “to building this important energy infrastructure project.” The company has also threatened to utilize “the US Circuit Court of Appeals” to push for the right to build their pipeline.

This decision comes after the Federal Energy Regulatory Commission (FERC) approved the 124 mile pipeline which would move natural gas from fracking sites in Pennsylvania to the eastern half of New York State.

The final necessary paperwork was the permit that has been rejected by the DEC for environmental concerns such as the fact that the pipeline “would affect 251 streams and 500 acres of valuable forest as well as extensive wetlands”, not to mention 700,000 trees and more than 700 parcels of land owned by private residents that the gas company could take possession of under eminent domain.

Julia Walsh, campaign director for FA commented: “Thanks to Governor Cuomo and the DEC, over 1800 acres of beautiful rural farmlands and forest, 277 streams, rivers and waterways, over 700,000 trees and the properties, health and lives of hard-working New Yorkers are protected from being destroyed by the Constitution Pipeline. This Earth Day, New York State lived up to our role as a national environmental leader.”
