House Approves Amendment To Limit Pentagon Drones Spying On Americans 0302 Drones full 600

The House of Representatives has approved an amendment to the draconian National Defense Authorization Act (NDAA) that will limit the Department of Defense from using data collected by unmanned spy drones against Americans.

The Amendment, introduced by Congressman Landry (R-LA), will prohibit information collected by DoD drones without a warrant from being used as evidence in court.

The amendment, was approved early Thursday afternoon along with 19 other en bloc amendments, reads:

“Notwithstanding any other provision of law, information acquired by an unmanned aerial vehicle operated by the Department of Defense may not be admitted in a Federal court, State court, or court of a political subdivision of a State as evidence against a United States citizen unless such information was obtained by such unmanned aerial vehicle pursuant to a court order.”

Landry’s amendment is an important one given that a recently uncovered Air Force document contends that the Pentagon can use drones to monitor the activities of Americans.

The instruction, dated April 23, admits that the Air Force cannot legally conduct “nonconsensual surveillance” on Americans, but also states that should the drones”incidentally” capture data while conducting other missions, military intelligence has the right to study it to determine whether the subjects are legitimate targets of domestic surveillance.

“Collected imagery may incidentally include US persons or private property without consent,” the instruction states.

The Air Force can take advantage of “a period not to exceed 90 days” to use the data to assess “whether that information may be collected under the provisions of Procedure 2, DoD 5240.1-R and permanently retained under the provisions of Procedure 3, DoD 5240.1-R.” it continues.

Should the drones capture data on Americans, the Air Force says that it should determine whether they are, among other things, “persons or organizations reasonably believed to be engaged or about to engage, in international terrorist or international narcotics activities.”

The instruction also states that the Pentagon can disseminate the data to other intelligence and government agencies, should it see fit.

“Even though information may not be collectible, it may be retained for the length of time necessary to transfer it to another DoD entity or government agency to whose function it pertains.” the document reads.

Congressman Landry tweeted about the approval of his amendment late yesterday:

Since the introduction of the NDAA in 2011, Congressman Landry has sought to nullify the legislation, calling it a “degradation of our rights”.

Landry has particularly railed against the provisions in the bill that have cleared the way for indefinite detention of American citizens.

“Sometimes our enemies are not obvious.” Landry commented in a December 2011 statement.

“In fact, the enemy that keeps me up at night is the slow erosion of our Constitutional rights. Over the last 30 years, Congress has wrongly handed over many of its Constitutional powers to the Executive – increasing the scope of government and decreasing our liberties.”

“The NDAA continues this trend by allowing the President to hold any individual associated with terrorist forces in ‘detention under the law of war without trial until the end of hostilities.’ While these provisions mention certain protections for American citizens, the language defining these exemptions could be interpreted to provide no protection.” Landry wrote.

In February, Landry gave an impassioned testimony before the Senate regarding the NDAA:

You can pass any bill or introduce any amendment and all you’ll do is pacify the civil reaction to the violation of our rights…As long as the CIA, the Security establishment, the FBI, State police, local city counsels and police feel themselves capable of personal interpretations of what is “right and good for their constituents”, they will violate every civil right we are entitled with.

    It’s selective enforcement that is the homeland version of authoritarian imperialism…when we see impeachment for sedition and prosecution for teason issued against those who bribe our public officials to do their bidding, we will see a hope of recovering of our liberty, freedom and personal interests…Where are the committees to determine who in the Pentagon structure is accountable for this proliferation of unacceptable technology?

    Nope, this type of activity is mostly theater.

  5. I forgot to add: Where are the local injunctions against the Federal use of military equiptment in violation of State’s airspace rights? There is no supportable precidence for federal juridiction over states air space…the question is: “Who has authority of the skies?” Federal jusisdiction? State? Local? and, “To what altitude do our property ownership titles convey authority?” Do our personal civil rights only apply if our feet are on the ground? Sounds ridiculous on it’s face but the rhetorical questions are essential to the discussion. AND, you hear no one speaking about this topic with these terms…

    It does not matter in the least RR.

    They will come out and “claim” any authority they need to in order to make their drone-wars happen in this country.

    Even if there is no legal, moral, or ethical backing for their actions they will INVENT some, or invent some “new” laws that allow only them complete control over everything.

    It is the trend our republic has been following for decades now and a late-commer to the game (drones) is not going to stop the trend the commies muzzies-lickers in power are heading towards.

    So, stock-up now on all kinds of ammo and other things that will help defeat their little toys as well as their new techno-gizmos.

    A few thermal blankets of the right material will make an excellent “hide” to snipe at these fuckers in the darkness they “own” at night.

  6. I want all the people who were involved in the destruction of the Constitution be held accountable for there actions. This goes back to World War 2. There is a lot of treason with some people and some need to be in prison and hanged for treason of the highest order. Including judges, x presidents, CIA, FBI, Homeland Security, TSA. Any agency who covered up the 9/11 tragedy.
    This country needs an enema. There is a blockage and it is going to be painful, but it has to be done.

    I find it distasteful that a Senator and his followers has to make amendments to a Act that should not even be attached to the constitution. I am glad for there courage, but this will just complicate things. They will just make another law to counter that amendment. It is insane the crap our congress and house of reps, some up with. We the People elected these Losers into there positions so they can destroy our Liberty and freedom.
    I am ashamed to call my self a US Citizen any more. Is it any wonder people are leaving the USA…?
