Jeffrey Gilham granted a retrial after murder convictions quashed

Jeffery Gilham who was found guilty of killing his parents two years ago, has had his convictions overturned and a court in Sydney has ordered a retrial.

JEFFREY Gilham has been granted a new trial after the NSW Court of Criminal Appeal overturned his convictions for murdering his parents in 1993.


The civil engineer has always maintained his older brother Christopher killed them, which he said provoked him into fatally stabbing his sibling.

Today, Justices Peter McClellan, Elizabeth Fullerton and Peter Garling overturned the murder convictions, ordered a retrial and granted him bail.

“We are of a unanimous point of view that the appeal will succeed, at least to the extent of quashing the conviction and ordering a new trial,” Justice McClellan said.

But he said the court was yet to consider whether or not any other order should be made, referring to the possibility the court could eventually acquit him.

The court was full of Gilham’s supporters, including his wife Robecca and Gilham himself, who smiled and appeared very relaxed.

In March 2009, Gilham, then 39, was jailed for life after being convicted of murdering his parents, Helen, 55, and Steven, 58, at the family home on Woronora, in Sydney’s south.

Their eldest son Christopher, 25, was fatally knifed in the same incident.

Jeffrey Gilham was placed on a five-year good behaviour bond after pleading guilty to his brother’s manslaughter in 1995.

He said he had been provoked into stabbing him after Christopher confessed to killing their parents and then setting Helen’s body alight in a fire.

But at his trial in 2008, the crown alleged Gilham killed all three family members before trying to cover his tracks.

As Gilham was led out of court by prison officers to enter his bail he was applauded by his many smiling supporters.

His tearful wife embraced him, prompting more clapping from onlookers.

His bail conditions include reporting to police weekly, surrendering his passport and signing an undertaking, without security, to forfeit $100,000 if he fails to comply with the conditions.

Earlier, Justice McClellan said the court was not in a position to give reasons for its decision.

“The reasons will have to await the ultimate resolution of the appeal,” he said.
