Lip reading not guesswork: expert

An expert lip reader asked to interpret from CCTV footage what was said during a fatal alleged assault at Melbourne’s Crown Casino has denied her skill relies on guesswork.

In what is believed to be a first in an Australian criminal case, Jessica Rees is giving evidence about what was said on footage captured by CCTV cameras at the casino during the July 2011 incident that led to the death of a patron.

Bouncer Matthew Lawson, 27, of Hoppers Crossing, is charged with the manslaughter of Anthony Dunning, 40.

His Melbourne Magistrates Court committal hearing has heard allegations bouncers verbally abused two of Mr Dunning’s friends as they lay restrained on the ground.

It is also claimed Lawson continued to hold Mr Dunning around the neck despite casino patrons telling security staff he was choking.

Ms Rees told the court on Thursday she had relied entirely on lip reading since the age of 17.

She said lip reading was reliable, especially when something was captured on CCTV and could be replayed a number of times.

Ms Rees has previously given evidence from lip reading recorded footage in court cases in England.

But she has not been used as a witness by the Crown Prosecution Service in England since 2005 after it was revealed she did not graduate from a degree at Oxford University. Previous court judgments indicate judges believed she had an Oxford degree.

Ms Rees told the court there had been a misunderstanding and she had dropped out of the course because her child was born early, shortly before she was due to sit her final exams.

Under cross-examination by barrister Lachlan Carter for bouncer Quoc Hai Tran, Ms Rees disagreed with suggestions that there was “a large amount of guesswork involved in lip reading”.

She also denied having any prior knowledge of the case and said she was never normally told of details of cases.

“You cannot change what is on the video,” Ms Rees said.

“For the sake of not having allegations thrown at me in court I just keep completely clear.”

Ms Rees’ report on what she witnessed on the CCTV footage has not yet been released to the media.

Tran, 34, Jacques Tony Fucile, 30, Nicholas Vladamir Levchenko, 26, Cameron Paul Sanderson, 40, and Benjamin Michael Vigo, 24 are facing lesser charges over the alleged assault on Mr Dunning or incidents involving two of his friends.
