Military Board Seeks Discharge of Marine for Obama Criticism

Marine Sergeant and Armed Forces Tea Party founder Gary Stein could face an “other than honorable” discharge from the service for criticizing and ridiculing President Obama on Facebook — at least if a General agrees with the military board’s controversial recommendation. Stein’s enlistment was set to end in just a few months.

Free-speech advocates from across the political spectrum rallied to the embattled Marine’s defense, saying the military was trampling on his rights and that dismissal from the armed forces would have a chilling effect on soldiers’ ability to speak freely. The American Civil Liberties Union (ACLU) and the conservative-leaning United States Justice Foundation both worked on Stein’s behalf.

After an all-day hearing on Thursday, however, a three-member Marine Corps administrative panel claimed the Iraq-war veteran had violated military regulations prohibiting partisan political statements and expressing contempt for the Commander-in-Chief. Stein was also alleged to have ignored warnings from superiors about his criticism of Obama.

The board’s discharge recommendation will go to the commanding General of the Marine Corps Recruit Depot San Diego, who will make a final decision. However, if the General disagrees with the panel — which Stein’s military attorney indicated was likely — the Secretary of the Navy could review the case.

An “other-than-honorable” discharge would mean that Sgt. Stein, a father who served for close to a decade and planned to re-enlist after his contract expires in July, would lose all of his military benefits. He would also be barred from joining other branches of the service and from entering bases, not to mention the blight on his record.

Stein attracted the scrutiny of his superiors after he created an “Armed Forces Tea Party” group on Facebook in 2010. According to prosecutors, he used the group to post “contemptuous” comments and images of Obama — including a picture of the President superimposed on the “Jackass” movie poster. Other members reportedly used the online organization to accuse Obama of “treason.”

Citing his oath to uphold and defend the U.S. Constitution, Stein also allegedly said he would not follow unconstitutional orders to detain, disarm, or violate any of the constitutionally protected rights of Americans. But as many of Stein’s supporters inside and outside the service have pointed out, U.S. military personnel can be and have been criminally punished under the Uniform Code of Military Justice (UCMJ) for obeying unlawful orders from their superiors.

Stein also used his Facebook account to blast Obama as a “coward” and an “economic and religious enemy” of America, according to the prosecutor. He allegedly sold “Nobama” bumper stickers from a personal website, too.

“This is what he’s putting out to the public, and he’s a sergeant of Marines, on active duty,” allegedCapt. John Torresala, who represented Stein’s chain of command before the administrative board. “How can this not be prejudicial to good order and discipline?”

Sgt. Stein’s attorney, however, argued that the anti-Obama comments were protected by the First Amendment’s guarantee of free speech, saying the remarks were made while he was off-duty and were not posted in any sort of official capacity. There was even a prominent disclaimer on Stein’s page specifically stating that the opinions were his own and that the Armed Forces Tea Party was not associated with the military.

  1. Instead of trying to discharge the Marine, how about if they do their job and go and arrest Obama for being an illegitimate president.

    After all they are suppossed to defend this country from all threats foreign AND DOMESTIC. Or is that just words?

  2. No sympathy for this Marine. Upon enlistment we are taught what we can do and what we can’t. He just wanted to change the rules. The military is NOT a democracy. We give that up upon entry and become literally “government property”. If he didn’t like it or the President he could have gotten out and exercised his free speech as a civilian. Easy enough. Wanted his cake and eat it too. I support his positions re. Our Pres. He knew better about his platform or lack of one to speak out about it. That’s just the wait is. The military relies on our civilian counterparts to ensure we don’t get killed for stupid reasons, and civilians count on us to protect them whenever and wherever the need arises. P.S the article makes one think he is losing benefits. There are no benefits for only 10 years of service. But he should get plenty of publicity out of this. So I bet hell make Luton the deal. Hell gain credibility, and get national face time. The dishonorable won’t hurt him. It would only hurt him if he was concerned with his honor. Which would be enough for a real Marine.

    Being a politically correct coward is why our country is bankrupt and we are runnng illegal wars. It is also why Hitler got the Germans to almost take over Europe. Just following orders from a criminal banker Presidents does not apply for punishment.

    Although sparton is correct about difference between civilian law and the UCMJ his tone is alarming. While serving in the service I never considered myself as government property but knew we were not allowed to what this Marine did without possible retribution. Since sparton feels he is government property he probably would have no problem “following orders” whether lawful or unlawful. And a less than honorable (General in my day) is no where near a dishonorable which unless they changed the UCMJ he cannot receive. Of course with today’s ‘new’, improved, diverse, equal, straight, gay,lesbian politically correct military one can surely be excused for believing it is a demockracy.

    It’s because of prlcks like you that we have such things as GENOCIDE.

    In the documentary “Night and Fog,” (about the concentration camp Mauthausen, where many French resistance were sent to die, as well as many of The Fifty escaped All0cied POW’s from The Great Escape), they showed the concentration camp personnel on trial at the end of the film. Each one of those ba$tards said, “Not guilty! I had ORDERS!”

    Tell me, spartan365, when you were stationed in the Middle East, did you gun down unarmed civilians because you had “orders?” You did, didn’t you, c0cksucker? In his book “The Deserter’s Tale,” Josh Key told how American troops were ORDERED to smash up Iraqi homes and steal private property, as well as to gun down unarmed civilians. You DID IT, didn’t you, c0cksucker?

    BTW, my Great-Uncle Steve was a “Teufelhundt” (what the Germans called our Marines during WW I). He and his buddies brought honor to the Corps.
