In a 5 to 4 vote, the Supreme Court ruled on Monday that it is permissible for jailers to strip search people arrested and jailed on minor offenses, even if they have not violated the law.

Supreme Court Rules Strip Searches OK for Minor Offenses 57060066.Image21Justice Kennedy wrote for the majority when he said that when an arrested person is to be put into the general jail population, “courts must defer to the judgment of correctional officials unless the record contains substantial evidence showing their policies are an unnecessary or unjustified response to problems of jail security.”

Justice Stephen Breyer dissented. He said strip searches improperly “subject those arrested for minor offenses to serious invasions of their personal privacy.”

The case reached the Supreme Court after Albert Florence was strip searched following his arrest on a warrant for an unpaid fine. In fact, the fine had been paid. It is not a crime in New Jersey not to pay a fine. After six days, Florence had not received a hearing on the case. He was transferred to another jail in Newark, New Jersey, where he was strip searched again. The following day, all charges were dropped and Florence was released.

The case represents a further erosion of the Fourth Amendment. For over thirty years, U.S. appeals courts have uniformly held that strip searches without suspicion violate the Constitution. Unless there is a reason for suspicion, the Constitution forbids searches without a court warrant.

In 2008, in the first appellate rulings on strip searches since September 11, 2012, appeals courts in Atlanta, Philadelphia and San Francisco ruled that the need of the state to maintain security justified a wide-ranging search policy, no matter the reason for someone’s detention and despite the protection afforded by the Fourth Amendment.

    If everyone took that attitude, this shit would stop today. The reason why we are being searched, harassed, and intimidated is because we let the government get away with it. Every time they violate the 4th amendment they should be greeted with a hail of led. If they are going to throw you in prison forever, you might as well take as many of the fuckers as you can with you. Set a precedent. Make them pay. If the feds get repeatedly punched in the face, they will give up. An armed, uncooperative, and hostile population is impossible to control. It is getting close to go time. Get ready to saddle up.

  11. So, if the 4th Amendment prohibits “unreasonable searches” then which of the following situations would be an example of an unreasonable search (assuming you were arrested for any of these minor offences)?

    If you are arrested for:
    1. Jaywalking.
    2. Spitting on the sidewalk.
    3. Littering (throwing a cigarette butt or gum wrapper in the street.)
    4. Selling lemonade on a sidewalk outside your home.
    5. Preaching about Jesus or displaying a Repent sign on a street corner.
    6. Denying global warming.
    7. Calling someone an offensive word.
    8. Pointing a finger at a cop.
    9. Being past due returning a borrowed item from the public library.
    10. Smoking in a no smoking zone.

    Amendment IV
    The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

  13. This ruling is a license to strip search everyone, in or out of custody, lawbreaker or bystander alike. I expect that every jail will now adopt a policy of strip searching everyone, everytime. This lends itself to an incredible level of abuse. Cops will now be able to pull over women, men, boys and girls on some trumped up charge, strip them naked in jail, and then let them go, with impunity. How about stopping a busload of school children on suspicion of drug possession? Strip the lot of them!

    Talk to your representatives at the federal and state levels and insist they pass corrective legislation.

    There is a documentary available on Net Flix entitled “Cool it,” it is well worth watching and puts many of these issues into their proper perspective. The Author is a noted environmentalist, who is from Sweden. He must be a threat to the system, as he has been attacked by Al Gore and other of his ilk. This man makes perfect sense, and once again I highly recommend it.

Both examples involved inside jobs, meaning the government itself was a perp. When and where will decent people come forth and organize a revolt?

I only hope this corruption comes back to haunt these creeps on the court by having one of their own children or grand children experience this kind of treatment first hand and have them confront the justice and hear what they have to say and then the relative disown them! Spit on the ground and disown them saying “Your dead to me!” It will take a while,but it may very well happen. When you are wrong your wrong! The truth stands on it’s own. Not on what any Justice says.
