Refugee advocates say the Immigration Department did not give a group of 10 Chinese nationals enough time to seek legal advice before they decided to seek asylum in Australia.

The group, which includes two children, was rescued while adrift at sea in their yacht last Thursday.

They originally planned to sail to New Zealand but instead made an application to seek asylum in Australia yesterday, after deciding it was too dangerous to continue the journey.

They have now been taken into immigration detention in Darwin.

The Refugee Action Coalition’s Ian Rintoul says the Immigration Department did not explain the issues properly.

“It was very clear from my discussions with them (the asylum seekers) that they didn’t understand the consequences of mandatory detention, they didn’t understand the length of time that they may be required to remain in detention while their claims were being processed,” he said.

Mr Rintoul says the Chinese nationals raised concerns they would not get a fair hearing in Australia.

“They felt that the Australian Government perhaps is too close to the Chinese government and that they may not get a full and independent hearing, that they’d get a fair hearing for their asylum claims,” he said.

The group’s members say they are from the Falun Gong and left China because of persecution.

“We didn’t all leave China together, we left at different times,” one of the men told the ABC through an interpreter earlier this week.

“We didn’t know each other then. We met in Malaysia at the UN and left Malaysia together by boat to go to New Zealand as refugees.”
