Mum with cancer wins super settlement

A Brisbane mum with terminal cancer has reached a settlement with a super fund that refused her claim, even though she called to check the fine print.

Leanne Myles, 35, is thrilled that she can now make the most of her time with sons Toben, 9, and Riley, 7.

Ms Myles was diagnosed with breast cancer in 2005 shortly after Riley was born.

She was deemed to be terminally ill in 2011 when it was discovered the cancer had spread to her brain.

Her lawyers, Maurice Blackburn, say Ms Myles was insured by Sunsuper superannuation at the time she was told she was terminally ill.

But Sunsuper and Suncorp Life say doctors failed to fill in forms before the policy lapsed.

John Berrill, head of Maurice Blackburn’s superannuation practice, on Friday said the settlement pays Ms Myles the full terminal illness benefit under her policy.

Ms Myles told AAP it was a huge relief.

“I know I’m able to provide something for their future and create some of those great memories that we planned to do ‘one day’, if we had the money,” she said.

Ms Myles said she phoned her insurer on learning her illness was terminal and confirmed she was eligible to claim.

“That put my mind at ease at the beginning because there was no indication that it was a matter of urgency,” she said.

Learning her claim had been refused because it wasn’t lodged on time was “infuriating”, Ms Myles said.

The time-consuming claim required the sick mum to have documents witnessed by justices of the peace and confirmation from two doctors that her life expectancy was less than 12 months.

“That’s a pretty confronting thing to have to accept in the first place, and to then be knocked back for what seemed like no reason was just a double blow,” she said.

“When you’re emotional and you’re not well, you’re relying on the people you call, the professionals, for the correct advice.”

A Suncorp spokeswoman said: “We hope this will provide Ms Myles with some comfort in relation to her family’s financial future.”
