Greg Kelly won’t be charged after an investigation into a woman’s claim of rape.
The son of New York City’s police commissioner will not be charged in a case alleging sexual assault, prosecutors said on Tuesday.
Greg Kelly, who is also a co-host of the local Fox television program “Good Day in New York,” was being investigated after a woman claimed he assaulted her after the two had drinks at a bar last October, according to NBCNewYork.com.
The woman filed the complaint on Jan. 25. Since then, investigators from the Manhattan District Attorney’s office have been unable to substantiate her claims, NBCNewYork.com reported.
“After reviewing all the evidence, we have concluded that the established facts do not constitute a crime under New York criminal law,” Manhattan District Attorney spokeswoman Joan Vollero told NBCNewYork.com.
The investigation included interviewing numerous witnesses, reviewing and analyzing physical evidence as well as text messages, phone records and other documents, Vollero said.

The investigation was handled by the district attorney because of the conflict of interest with Police Commissioner Ray Kelly.
Earlier on Tuesday, Kelly’s lawyer was notified that charges would not be brought against his client. Kelly has strongly denied any wrongdoing.
On Jan. 28, Manhattan District Attorney Cyrus Vance told NBCNewYork.com that the team investigating the woman’s complaint against Kelly included a sex crimes unit run by “one of the world’s most foremost DNA experts.”
The woman told police she and Kelly met on the street and went to have drinks at Jeremy’s Ale House at South Street Seaport. Afterward, the two went to her office at a law firm, and that’s where the rape occurred, according to the woman.
She and Kelly exchanged phone and text messages afterward that appeared friendly in nature; he expressed that he wanted to see her again and she indicated she had a good time, a source told NBCNewYork.com.
Kelly has not appeared on “Good Day New York” since Jan. 26, having requested some time off, according to WNYW-Fox 5 station manager Lew Leone.
Kelly, 43, joined Fox News Channel in 2002 and was the White House correspondent from 2005 to 2007, according to his biography on WNYW’s website. A Marine Corps veteran and reservist, he also covered the Iraq War, including four assignments in Baghdad.
