Obama Overrides Congress to Rewrite US Immigration Laws to Suit his Political Agenda

President Barack Obama has pushed the boundaries of his executive powers before; even to the point of dictatorship . This latest use of presidential power to further his political objectives is no acceptation.

Obama is using the Hispanic population in the US as pawns in a bid to gain support for his re-election campaign. This executive order is also perfectly timed ahead of Obama’s scheduled address to the National Association of Latino Elected and Appointed Officials in Florida (NALEO).

Ignoring laws passed by the US Congress, Obama has written an executive order encompassing a grab for power that no president show ever have access to.

“This isn’t about immigration but about constitutional order,” says Mark Krikorian, executive director of the Center for Immigration Studies , a conservative-leaning think tank. “One problem is that even Democrats in Congress now have no right to complain about future usurpations – they might as well all go home and have Napoleon run the country.”

Obama is taking the issue of immigration into his own hands, and accusing Congress of “[standing] by and do nothing while so many families are struggling.”

This announcement coincided with the 30th anniversary of the US Supreme Court decision that stated children of illegal-immigrant parents were entitled to public education in the United States.

Obama asserts that the law is on his side, while critics feel that this is another aggressive re-interpretation of the power of the executive branch.
Senator Charles Grassley of the Senate Judiciary Committee says that only the US Congress “has the authority to write immigration laws.”

House Representative Steve King states: “Americans should be outraged that President Obama is planning to usurp the constitutional authority of the United States Congress and grant amnesty by edict to one million illegal aliens.”

Accompanying the new policy is a deferred action provision for a period of two years subject to renewal as well as eligibility for worker’s authorization for those who meet certain requirements.

Obama’s EO allows undocumented youth under the age of 16 who have been in the U.S. for 5 years or more and are willing to pursue an education or join the military. These youth will be able to apply for work permits, but not permanent residency in the US.

Many governmental leaders in the past, like Hitler’s Nazi Youth Group, have successfully created youth brigades similar to Obama’s EO that states that those illegals could join the military in order to remain in the US.

This is not a pathway to citizenship, but rather, according to Obama, “a temporary stop-gap measure that will allow us to focus resources wisely while giving a degree of relief and hope to talented, driven, patriotic young people.”

Janet Napolitano, secretary for the Department of Homeland Security (DHS) says that their focus is only on young people who the US government regards as not to be a national security threat. Obama and Napolitano have worked together to create an itemized, three-page memo on deportation policy.

The Immigration and Nationality Act (INA) gives DHS general authority to enforce immigration laws. Federal courts, moreover, have recognized that officials can exercise their discretion in determining deportation priorities.

More than 830,000 people will be added into a free-falling labor market in the US.

This EO appears to be a political move against Mitt Romney, who is promising to act swiftly against undocumented immigrants if elected to the presidency in November.

Senator John McCain says: “Today’s announcement by President Obama is a politically motivated power grab that does nothing to further the debate but instead adds additional confusion and uncertainty to our broken immigration system.”

Romney also accuses Obama of using this EO to create more confusion to an already convoluted immigration system.

Lamar Smith, chairman of the House of Representatives Judiciary Committee, says Obama’s EO will have “horrible consequences” on unemployed Americans seeking jobs in a failing market. Obama is handing American jobs to illegal immigrants who have traditionally been willing to accept lower wages than the average American.

In a court of law, Obama’s EO would not be successfully challenges as in the past, US Presidents have broad executive power for temporary orders and prosecutorial discretion.

Michael A. Olivas, law professor for the University of Houston, claims Obama’s EO is “well within a president’s usual authority.”

Senator Marco Rubio, who is seeking a future run for US president states: “By once again ignoring the constitution and going around Congress, this short-term policy will make it harder to find a balanced and responsible long-term one.”

It is expected that President Obama and Senator Rubio would meet at the NALEO address, where immigration would be a hot topic.

Mexican President Felipe Calderon is excited about Obama’s decision and wrote on his Twitter account: “It is just recognition to their contributions.”

With an estimated 12 million Mexican illegal immigrants living in the US, Obama’s executive order would benefit 1.4 million children and young adult, according to the Pew Hispanic Center .
