A federal appeals court in San Francisco has dismissed a veteran’s conviction for wearing medals he didn’t earn, saying it’s protected by the First Amendment. Misrepresenting or lying about your credentials and/or character is “protected speech”, even when testifying in a court of law, the 11-judge panel ruled.
This is truly unbelievable!
According to US News, a federal appeals court on Monday tossed out a veteran’s conviction for wearing military medals he didn’t earn, saying it was a form of free speech protected by the Constitution.
A specially convened 11-judge panel of the 9th U.S. Circuit Court of Appeals ruled that the First Amendment allows people to wear unearned military honors.
Elven Joe Swisher of Idaho was convicted in 2007 of violating the Stolen Valor Act, which made it a misdemeanor to falsely claim military accomplishments. President George W. Bush signed it into law in 2006, but the U.S. Supreme Court struck it down in 2012 as a violation of free speech protections.
Swisher testified that David Roland Hinkson offered him $10,000 to kill the federal judge presiding over Hinkson’s tax-evasion case. Swisher said Hinkson was impressed after Swisher boasted that he killed “many men” during the Korean War.
Prosecutors say Swisher enlisted in the Marine Corps a year after the Korean War ended but was never wounded in the line of duty. Swisher was honorably discharged in 1957, and discharge documents indicate that he didn’t receive any medals, according to the 9th Circuit ruling.
He put it on and wore it under oath, while he was testifying. What message was he trying to send there? That he lies about his own deeds and character, so by all means, trust him when he submits this testimony? And what does this say about our judicial system? I for one am stunned!
There was once a time that honor was woven into the very fabric of our nation, now not so much. The liberal progressives are using our constitution against the very people who built America into the greatest nation on earth. Being a veteran I am offended and disgusted by this man’s actions and every freedom loving American should be speaking out against this ruling.
Everyone knows this guy’s name now so he should be shunned as much as possible. If he had apologized, been contrite and offered service to veterans then he could could be forgiven. Yet he continues to defy. If you didn’t earn it and or weren’t awarded it, don’t wear it. If you are a vet, just be proud to have served.
