Three of billionaire Gina Rinehart’s children allege she deceived them by deliberately changing the vesting date of a family trust without their permission.

John Hancock, Bianca Rinehart and Hope Rinehart Welker started the case against their 58-year-old mother in September.

They want her removed as head of the multi-billion-dollar trust, alleging she engaged in serious misconduct.

They were due to access the trust last year but say their mother changed the date to 2068.

Documents released today by the Supreme Court contain allegations Gina Rinehart threatened her children they could face bankruptcy if they did not extend her control of the trust.

In one email she says legal action they were taking against her “will never work”.

In a statement of claim against her mother Bianca Rinehart says that the chief financial officer of Hancock Prospecting told her that if she withdrew from the legal action her mother would pay her a “quarterly distribution” and asked her to suggest an amount.

The documents include a letter from Nationals Senator Barnaby Joyce to Ms Welker, urging her not to make the dispute public.

Senator Joyce, a long-term friend of Gina Rinehart, says his involvement in the feud was a personal one.

He said his message to the children was that media coverage would not help.

“In the long term, you only hurt yourself and the family because no matter what side of the debate you’re on … it’s like going into a divorce and putting in on the paper, there’s no winner,” he told Sky News.

The documents also contain an email from Liberal MP Alby Schultz and his wife describing the legal action as a “horrific step”.

Gina Rinehart is disputing the allegations her children have made against her.

The allegations of deception and fraud could have serious ramifications for the businesswoman, who sits on the boards of multiple companies.

[Gina Rinehart’s] children say that she breached her duty to act honestly and in good faith; that she acted with gross indecency in her dealings with the beneficiaries of the trust; and that she acted deceitfully in her dealings with the beneficiaries i.e. her own children.

And what her children are alleging is that she was more or less saying to them, ‘do it the way I want to do it or you’ll face the consequences’.

If [Gina Rinehart] is charged with anything more serious or if this does lead to further court matters, she could be prevented from sitting on company boards. And this particular trust owns approximately 23 per cent stake in her mining company.

Gina Rinehart’s youngest daughter Ginia is supporting her and has again made a public statement on the feud.

In the statement she accuses her brother of making gross misrepresentations in the media.

She says she feels sorry for him because he feels the need to create falsities and spread them globally.

Ginia Rinehart has again described the case as “nothing but a destructive display of greed, jealousy and a selfish sense of entitlement on behalf of my siblings”.

‘Deplorable’

Ms Welker later released another statement in which she said she was “deeply saddened” by her sister’s statements.

“We have been very close our entire lives and I fear she has been used by our mother since at the time when the proceedings commenced Ginia sent an email saying she supported us 100 per cent,” the statement said.

“We did not want to go to court but were given no option when threatened with bankruptcy if we did not immediately sign a deed to further relinquish our rights as beneficiaries.

“All we want is to ensure the assets and income of the trust are managed in a proper and lawful fashion.

“It is deplorable that we are subject to such vitriolic attack, from such coordinated opposition, in taking that stand; the full facts can now be known and the public can judge for themselves.”
