A woman is suing retailer Woolworths, alleging she slipped on a grape and injured herself.
Nola Joy Hollett, 61, claims she fell while in the confectionary aisle of the Woolworths supermarket at Port Lincoln in South Australia in February 2009.
In Adelaide District Court documents, Mrs Hollett alleges Woolworths and its staff were negligent.
“[Woolworths] failed to take reasonable care to ensure the safety of the plaintiff while shopping at the premises,” the documents said.
“It ought to have been aware of the presence of the grape on the floor and failed to have in place measures to eliminate, reduce or warn against the danger created.
“[Woolworths] permitted the floor to become and/or remain in an unsafe or dangerous condition … and failed to have in place an adequate system of inspections and cleaning, which would have alerted it to the presence of the grape on the floor.”
Mrs Hollett said she injured her shoulder, neck, leg and spine and her physical and psychological injuries had reduced her earning capacity.
In its defence, Woolworths Limited said Mrs Hollett had failed to watch out properly and the fall was so minor it could not have caused the levels of injury, loss and damage alleged.
“The plaintiff has sufficiently recovered from her injuries such that she can return to her pre-fall sporting, social, domestic, recreational and other activities,” the company said.
The case is listed for a settlement conference in January.
