SWAT Team Serves Eviction Notice Even Though ‘Suspect’ Was Already in Custody!

Usually eviction notices are served by a Sheriff, Landlord or Legal Processor and not by a SWAT team riding in a Bearcat. Yet, that’s exactly what happened to Ken Ball and his family according to The Denver Channel:

An armored vehicle, a swat team armed with guns outside Ken Ball and his family’s home caused them to grab their cell phone and record their frustrations.

The eviction notice carried was out by Parker Police and the Douglas County Sheriff’s Office.

In the cell phone video, one of Ball’s family members claims they were blindsided by all of this.

The Douglas County Sheriff’s Office says when deputies serve eviction notices they are typically not heavily armed, however, this eviction notice was different.

Chief Johnson says Ball had two warrants out for his arrest and has been trespassing and living in the home for the last two years.  He made threats to law enforcement on social media saying, “Come try and remove me from this home. You’d better come in full gear guys because you’ll know something is really dirty.”

Johnson said before heading out, his team put their operational plan into a multi-page document.

Johnson said it was all in effort to try and avoid a tragedy like the one in Park County where Deputy Nate Carrigan was shot while serving an eviction notice.

While the article leads you to believe that Mr. Ball was not only squatting but threatening law enforcement he claims that’s simply false.

Ball says that this is a family dispute and that he’s been paying on the house for nearly two years. There were no issues with the agreement of the property, which is the estate of Ball’s cousin but his Mother has legal control over the estate, until the value spiked thanks to the housing boom in Colorado (thanks to legal marijuana).

And I agree, this shouldn’t have been a police issue to begin with and is yet another reflection of the lack of service with government entities. If the courts were actually efficient this matter would be resolved already but that’s another matter.

My concern here is with a SWAT Team being used for an eviction notice…. so back to that.

While Ball admits his Facebook status could have been more clear he claims to have been implying that the court process, that his family members are using to remove him from the house, is what’s “dirty.”

Whether or not the police thought Ball is, or was, a threat is irrelevant because the SWAT Team arrested him before even coming to his house. That’s right, that wasn’t mentioned at all in the new story whatsoever.

On the day the eviction notice was served but before a SWAT TEAM in a bearcat arrived Ball received a call from a person looking to buy a mattress. Since that’s how Ball earns his living he took down the information of the person, type of mattress they wanted and headed off to his storage unit to pick up the product.

Little did Ball know but the customer on the phone wasn’t a customer at all but the police themselves. The call was merely a set up to lure Ball away from the home and arrest him. In fact, I’m surprised the police choose this method instead of the 4 AM no knock style that they usually use.

Ball stated to me that the police said they did that so that they wouldn’t “terrorize his family” with men in SWAT gear and big guns. Yet, after Ball was secured and on his way to jail the SWAT Team did exactly what they said they didn’t want to do and terrorized his family anyways.

So why did Ball’s partner and their child still face a SWAT team and bearcat outside their home AFTER Ball’s arrest? I wouldn’t know and my request for the body camera footage with policy mentioned in news cast when unanswered.
