Terminally ill mum sues insurer

A Brisbane single mum with terminal cancer is suing one of Queensland’s biggest superannuation funds, which won’t accept her claim.

Leanne Myles, 35, was deemed terminally ill in early 2011.

She was diagnosed with breast cancer in 2005 shortly after the birth of her second son.

In March 2011 Ms Myles discovered the tumour had spread to her brain and underwent aggressive chemotherapy treatment.

In documents filed in the Brisbane Supreme Court, her lawyers Maurice Blackburn say she was insured by Sunsuper superannuation when she was told she was terminally ill.

The claim says Sunsuper and Suncorp Life and Superannuation Limited say doctors failed to fill in forms before the policy lapsed.

Lawyer Paul Watson says it’s “outrageous” that Ms Myles’ claim won’t be accepted, as she simply wants to provide financial security for her sons, aged six and nine.

“Sunsuper should be looking out for their members, not trying to put up roadblocks,” Mr Watson said.

“Terminal illness insurance is, in that respect, no different to car insurance.

“So long as you are insured at the time of the car accident, you should be paid.”

In 2005, Ms Myles and her then partner Scott Bradshaw campaigned for wider access to Herceptin, a drug that became available on the PBS for some women the following year.
