Trial date for man on Malaysia drug charge

A West Australian man facing mandatory death in Malaysia over drugs charges will appear in the High Court on June 8, when a trial date will be fixed.

Perth man Dominic Jude Christopher Bird, 32, was charged officially with one count of drug trafficking and one count of drug use on May 21, after prosecutors said the substance he was allegedly arrested with contained 167 grams of methamphetamine.

Bird had previously been “provisionally” charged under Section 39B of Malaysia’s Dangerous Drugs Act, which carries a mandatory death penalty for more than 50g of methamphetamine.

He was arrested by undercover officers on March 1 at a Kuala Lumpur coffee shop, where police allege he was trying to sell them 228g of the drug.

A chemist’s report tendered during last week’s hearing in Kuala Lumpur confirmed the substance was about 73 per cent pure methamphetamine, prosecutors said.

Bird has pleaded not guilty to both charges.

The drug use charge is based on a positive methamphetamine urine test police allegedly took when Bird was first arrested.

Bird’s Malaysian-based Australian lawyer, Tania Scivetti, told AAP on Friday her client’s next court appearance would be at 9.30am on Friday, June 8, in the Kuala Lumpur High Court.

She expected a trial date to be set for some time in November.

“He’s in good spirits,” Ms Scivetti said.

“He’s happy that things are moving fast.”

Ms Scivetti said Australian consular officials were taking good care of Bird, after his Perth-based father had visited him and returned home.

Bird has no other family in Malaysia.

Malaysia has executed three Australians for drug offences.

Kevin Barlow and Brian Chambers were hanged in July 1986, followed by Michael McAuliffe in June 1993.
