Vic human rights commission board resigns

Victoria’s Equal Opportunity and Human Rights Commission has been left without a functioning board after all members, bar one, resigned.

On Tuesday evening three of the board’s remaining four members faxed their resignations to Attorney-General Robert Clark, citing Mr Clark’s recent veto of a unanimous board decision as their reason for leaving.

Richmond Football Club CEO Brendan Gale, Monash Law Associate Professor Paula Gerber and Carman’s Fine Foods CEO Carolyn Creswell issued a statement on Wednesday, outlining why they had resigned.

They say while they accepted the attorney-general has discretion to approve or reject board recommendations, this should be done in a reasonable, appropriate and transparent way.

“We see the attorney-general’s refusal to accept the recommendation of all seven board members as evidence of his lack of confidence in the board’s ability to perform its statutory duty,” the statement said.

“(We) therefore consider it appropriate to step aside so the attorney can appoint a new board in which he does have confidence.”

The decision that led to the mass resignation was over the appointment of a new commissioner.

The statement said the board undertook a rigorous recruitment process to identify a suitable candidate to replace Dr Helen Szoke who resigned on August 2, 2011, to take up the position of federal race discrimination commissioner.

They made a unanimous recommendation to the attorney-general on April 2.

However Mr Clark rejected the recommendation.

The board’s chair John Searle is the only remaining member after the recent resignations of Joumanah El Matrah and Michael Gorton.

Professor Kurvilla George resigned in May after his endorsement of a submission opposing same-sex marriage attracted controversy.

The departing board members said they had confidence the commission will continue to function as usual.
