WA MP may face action over mail-out

West Australian independent MP Janet Woollard could face legal action over more than 14,000 letters posted to households in her electorate attacking a young woman who was almost killed in a boat crash caused by her intoxicated son.

Kate Campbell, 24, successfully sued Luke Woollard, 23, in the District Court in March to recover $230,000 in medical bills, lost earnings and dental treatment.

She suffered life-threatening injuries after a drunken Mr Woollard crashed his father’s ski boat on Perth’s Canning River in the early hours of November 7, 2007.

Woollard was ferrying people, including Ms Campbell, after a day and night of heavy drinking to celebrate end-of-year university exams.

He had received a suspended sentence in earlier criminal proceedings after pleading guilty to causing grievous bodily harm, but has refused to pay the civil settlement, claiming he has no money.

This week, more than 14,000 households in Mrs Woollard’s Alfred Cove electorate received a letter from the MP claiming the civil trial “was part of a campaign to vilify our family and force us to pay additional money”.

The letter claimed two offers of $100,000 had been made to Ms Campbell before the trial and she refused.

Mrs Woollard told AAP on Wednesday she had paid for the mail-out herself and did not use an official letterhead – although the letters list her electorate office number and state she is the member for Alfred Cove.

Lawyer John Hammond, who represented Ms Campbell during the trial, told AAP a response to Mrs Woollard’s letters would be “coming out in the next 24 hours”.

While Mr Hammond did not go into details, he said, “Janet Woollard is impugning my client’s honesty in her circular.”

“Janet Woollard is making Kate a political football by writing to every member of her electorate,” Mr Hammond said.

“It’s a savage attack on my client.”

Ms Campbell confirmed to AAP she was talking to Mr Hammond about possible legal action against Mrs Woollard.

“It’s something we might look into,” she said.

The Woollard family, which includes prominent cardiologist Keith Woollard – who had not insured his boat – has come under fire from the WA opposition and others for bankrolling Luke’s civil case but refusing to help him pay the settlement.

Mrs Woollard would not disclose how much the case had cost the family – including hiring a well-known barrister and two solicitors – but admitted “in hindsight” the money would have been better used trying to reach a settlement with Ms Campbell.

“We certainly tried,” she said. “I wish the whole issue had been settled years ago.”

Mrs Woollard said the $100,000 offers to Ms Campbell were “flat-out rejected” and there had been no counterproposal.

However, Ms Campbell told AAP a counterproposal was made.

“It was less than the amount I was awarded in court, and they turned us down,” she said.

Ms Campbell said she was “completely astounded” by Mrs Woollard’s mail-out and said it was “more evidence that the family has no idea how to live up to any responsibilities”.
