Martial Law
The exercise of government and control by military authorities over the civilianpopulation of a designated territory.
Martial law is an extreme and rare measure used to control society during war orperiods of civil unrest or chaos. According tothe Supreme Court, the term martiallaw carries no precise meaning (Duncan v. Kahanamoku, 327 U.S. 304, 66 S. Ct.606, 90L. Ed. 688 [1946]).
However, most declarations of martial law have somecommon features. Generally, the institution ofmartial law contemplates some use of military force. To a varying extent, depending on the martial law order, government military personnel have the authority to make and enforce civil andcriminal laws.
Certain civil liberties may be suspended,such as the right to be freefrom unreasonable searches and seizures, freedom of association, and freedom ofmovement.
The writ of Habeas Corpus may be suspended (this writ allowspersons who are unlawfully imprisoned to gain freedom througha court proceeding).
In the United States, martial law has been instituted on the national level only once, during the Civil War, and on a regionallevel only once, during World War II.
Otherwise, it has been limited to the states. Uprisings, political protests, labor strikes,and riots have, at various times, caused several state governors to declaresome measure of martial law.
Martial law on the national level may be declared by Congress or the president.Under Article I, Section 8, Clause 15, of theConstitution, Congress has the power“ [t]o provide for calling forth the Militia to execute the Laws of the Union,suppressinsurrections and repel Invasions.”
Article II, Section 2, Clause 1, of theConstitution declares that “[t]he President shall beCommander in Chief of theArmy and Navy of the United States, and of the Militia of the several States, whencalled into theactual Service of the United States.”
Neither constitutional provision includes a direct reference to martial law. However, theSupreme Courthas interpreted both to allow the declaration of martial law by the president orCongress.
On the state level, a governor may declare martial law within her or his own state. The power to do so usually is granted in the state constitution.
How to Survive Under Martial Law
A major disaster, war has happened to you and to your area to
such a degree that the government has declared Martial Law. The more
often used “State of Emergency” is similar to this, only weaker.
Martial

trial, etc. Here is how you should behave to survive a period of Martial
Law.
Who can Declare Martial Law:
- In the USA:
- The President of the US
- A State governor – for his/her state only
When this is done, all military forces are called up into active duty
and will remain active until what prompted the declaration is negated.
Other nations have different criteria for declaring Martial Law. Example:
- In Pakistan:
- The Chief of Army Staff
- In Argentina:
- The President with authorization from two thirds of the Congress.
Steps
1# Comply with all directives. Failure to do so will get you shot and killed.
2# Observe any curfews.
3# Prepare ahead of time by getting

Two or more self powered radios and self powered flashlights.
Batteries will be hard to find, and candles forbidden for safety
reasons. -

Water, a month’s supply per person and a water purification unit

All pertinent medications

4# Keep an eye on the news, especially if and when the U.S. is ever hit again in a “9-11” attack, a major
disaster hits the US, such as an earthquake in the New Madrid area,
another hurricane hits a major city, as what happened to the Gulf Coast
when Hurricane Katrina hit it.
