At least 250 women to sue British clinics after their silicone breast implants were involved in cancer scare

At least 250 women with breast implants made by the French company at the centre of a cancer scare intend to sue at least six clinics in the UK.

The women are pursuing the action after the French government told all women there with the implants filled with an industrial silicone – believed to be made for mattresses – to have them out and said it would foot the entire bill in up to 30,000 cases.

Mark Harvey, a partner at Hugh James solicitors, which is pursuing the legal action, said: ‘We wanted to pursue claims against [makers] PIP or its insurers, [but as the company has since closed] it is quite clear that is not viable.

Instead he said the women would be pursuing action against the British clinics where they had the operations, and they will apply for the cases to be treated as a class action at a hearing in Cardiff next month.

He said that the clinics had charged clients thousands of pounds to fit the implants, worth only a few hundred pounds, and had entered into contracts promising the implants would last a lifetime and would not rupture or leak silicone.

‘We have spent a lot of time trying to persuade clinics to resolve the matter without going to litigation,’ he said. ‘That has not worked so far.’

Health officials in the UK last night said that there was no evidence that the breast implants made by PIP (Poly Implant Prothese), which are thought to have been used on 42,000 people in the UK, increased the risk of cancer and urged patients not to panic.

The Medicines and Healthcare products Regulatory Agency (MHRA) said that it had consulted with experts in nine countries over safety concerns surrounding the French-made implants.

But it said all had agreed that there was nothing to show that there was nothing to show that there is a heightened risk of the disease with the implants that were filled with a silicone gel believed to have been made for mattresses.

MHRA officials have spoken to health or regulatory experts from France, the Netherlands, Portugal, Italy, Ireland, Hungary, Austria, Denmark and Malta.

A spokesman from the Department of Health said: “They all agreed that there was no evidence of any increase in incidents of cancer associated with PIP breast implants and no evidence of any disproportionate rupture rates. This is in line with UK findings.’

New figures from the MHRA published last night suggest 84,300 of the implants, manufactured by PIP, have been sold in the UK since 2001.

Based on the assumption that each woman has two implants, an estimated 42,000 women in the UK could be affected, according to the MHRA.

But the figure could be higher because women undergoing breast reconstructive surgery following cancer may only have had one implant.

Data from the MHRA shows it has received 411 reports of PIP implants failing in British patients since 2001.

This would suggest around one per cent of women in the UK with PIP breast implants have suffered implant failure, including rupture, compared to a claimed failure rate of five per cent in France.

The implants have been linked to the death of a French woman from a rare form of cancer called anaplastic large cell lymphoma (ALCL), and are implicated in another seven or eight cancer cases.

Come off it ! Common sense tells you that putting nasty things inside your breast area is asking for trouble. They all knew the risks.Greedy,stupid women. ( Think I’m going to sue all major car manufacturers because they have been known to run people over ).
