Lin family murder accused’s bail bid



THE man accused of murdering five relatives in their home could not have done so because he had no military or martial arts training, a court has been told.


And a bail hearing has also been told that the fact the surviving teenage relative of the Lin family is “sticking by him” is a reflection of Robert Xie’s innocence.

Robert Xie, 47, is applying for bail in Sydney’s Central Local Court this morning after being in custody for seven months on five murder charges.

Xie is accused of murdering his brother-in-law Min Lin, Min’s wife Yun Li ‘Lilly’ Lin, their two children and Lilly’s sister Yun Bin ‘Irene’ Lin on July 14, 2009.

Xie’s barrister Graham Turnbull SC has told Magistrate Julie Huber that DNA evidence in the form of a blood smear that police will claim links him to the crime was so tentative it could ultimately be excluded as evidence.

Mr Turnbull said the difficulty of the DNA evidence, which he told the court led to Xie’s arrest, rested on the timing of where it was found and its placement.

He said his client, who has no criminal history, lacked the “military” or “martial arts” experience that would make him capable of bashing five people to death, particularly when police evidence shows three of them put up a fight against their killer.

“They would have had to have a capacity engendered by some degree of familarity in the administration of these kind of injuries,” Mr Turnbull said.

“His wife and the deceased’s daughter are sticking by him….it’s a commitment which reflects well on him as a man.
