Memoir used as evidence against fraud

A Tasmanian grandmother who claimed $200,000 over 16 years from the single person disability pension is facing jail after she revealed in an autobiography that she had a live-in husband.

Joyce Ellen Leary, 62, from Lindisfarne, has pleaded guilty in the Supreme Court to three counts of defrauding the Commonwealth by claiming social security benefits from 1994 to 2010, the Mercury reports.

Leary, who the court heard told Centrelink she could not work because of emotional and mental illness from the mid-1990s, last year published her book Breaking the Mould which was seized as evidence after Leary continued to deny she was in a relationship at the time.

Leary’s house was raided after an anonymous tipoff.

The book’s chapter “My Life, My Loves and My Temper” provides a detailed account of her relationship with her husband who she married in 1969.

Other evidence included Leary’s diary, hospital records and will which named her husband as next of kin.

The couple bought and sold several houses while Leary was receiving benefits. She also had bank accounts she did not tell Centrelink about containing tens of thousands of dollars.

“Joy’s story is honestly, frighteningly and realistically portrayed. It is one of extraordinary strength of character and one that led her through a fascinating career and life, completely different to that into which she had been born,” the book’s Facebook page promises.

Leary’s lawyers disputed the amount of money dishonestly acquired from the Commonwealth.

They said Leary and her husband were now getting a divorce because she was in a relationship with another man. Her book said she had undertaken numerous affairs.

Leary remains in custody and is due to be sentenced June 1.
