Most air travelers now endure naked scans or genital pat-downs by gloved agents of the government without surprise or complaint. But before invasive security became normal, there was a backlash. And at its height, Transportation Security Administration boss John Pistole said something revealing. “I see flying as a privilege that is a public safety issue. So the government has a role in providing for the public safety and we need to do everything we can in partnership with the traveling public, to inform them about what their options are,” he told reporters. “I clearly believe that passengers have a number of options as they go through screening. But the bottom line is, if someone decides they don’t want to have screening, they don’t have the right to get on the plane.” What perturbed me wasn’t his defense of mandatory security screening. It was his assertion that air travel is a special “privilege” the feds grant citizens.

I felt the same uneasy twinge when Janet Napolitano, who heads the Department of Homeland Security, told USA Today that “if people want to travel by other means, they have that right.” Because where does that attitude end? Is it a “privilege” to attend the Super Bowl, where TSA agents scan the crowd for suspicious behavior? Or to ride on a Metro system, an Amtrak train, or a boat — other forms of transportation that Napolitano has mused about targeting? As Mark Browning wrote in 2010, using hyperbole and reduction ad absurdum to mock Napolitano, “The bus system could come next. Come to think of it, so could travel by automobile… Here, we find that not only are the crevices of our bodies searched, but so are the contents of our cars. If you don’t like it, don’t drive. Nowhere in that living document, the Constitution, are we assured of our right to move without hindrance from point to point by private automobile.”

Of course, that would never really happen… would it?

In the local news report above, which my colleague James Fallows notes here, a Tennessee TV news broadcast reports that TSA is already operating on highways in the state. The brilliant reasoning? “Where is a terrorist more apt to be found? Not these days on an airplane more likely on the interstate,” said Tennessee Department of Safety Homeland Security Commissioner Bill Gibbons. Perhaps he can be forgiven for this absurd quote. After all, his job is to keep Tennessee safe from terrorists. By definition he’s guarding against a remote threat. But it ought to make us all upset that the federal government assessed its counter-terrorism resources and decided that the best use of scarce funds would be random checks on vehicles on Tennessee highways.

Feel safer?

The TSA agents are urging all drivers to “say something” if they see something suspicious, which brings us to another great quote from the piece: “If somebody sees something somewhere, we want them to be responsible citizens,” says Paul Armes, TSA Federal Security Director. “Report that and let us work it through our processes to vet the concern they had when they saw something suspicious.” Granted, if I were driving (rather than traveling by train) to Chattanooga, and I saw an 18 wheeler with a “Death to America” bumper sticker and fertilizer spilling out the back, I’d call the cops; but if there were any actual terrorists on the highways of Tennessee, wouldn’t their explosive filled truck look, from the outside, like any other truck?

The last thing America needs is to let TSA and its absurd, security-theater loving bureaucrats out of the airport. Reports a local newspaper: “Larry Godwin, deputy commissioner of TDSHS, said the checks at the weigh stations were about showing the people of Tennessee the government is serious about transportation safety.” But quotes like that in fact show that they aren’t serious about transportation safety so much as the appearance of it. I’d consent to beefing up airport security even more if it meant being able to keep TSA agents inside the terminal. The notion of random searches spreading everywhere in American life, whether you’re exercising the “privilege” of going to a sporting event or driving down the highway, amounts to an unconstitutional surrender to terrorism in places where we’ve never even been hit by it.

    DESPITE ACTIONS OF POLICE AND LOCAL COURTS, HIGHER COURTS HAVE RULED THAT AMERICAN CITIZENS HAVE A RIGHT TO TRAVEL WITHOUT STATE PERMITS

    FK OFF TSA

    For years professionals within the criminal justice system have acted on the belief that traveling by motor vehicle was a privilege that was given to a citizen only after approval by their state government in the form of a permit or license to drive. In other words, the individual must be granted the privilege before his use of the state highways was considered legal.
    Legislators, police officers, and court officials are becoming aware that there are court decisions that disprove the belief that driving is a privilege and therefore requires government approval in the form of a license. Presented here are some of these cases:
    CASE #1: “The use of the highway for the purpose of travel and transportation is not a mere privilege, but a common fundamental right of which the public and individuals cannot rightfully be deprived.” Chicago Motor Coach v. Chicago, 169 NE 221.
    CASE #2: “The right of the citizen to travel upon the public highways and to transport his property thereon, either by carriage or by automobile, is not a mere privilege which a city may prohibit or permit at will, but a common law right which he has under the right to life, liberty, and the pursuit of happiness.” Thompson v. Smith, 154 SE 579.
    It could not be stated more directly or conclusively that citizens of the states have a common law right to travel, without approval or restriction (license), and that this right is protected under the U.S Constitution.
    CASE #3: “The right to travel is a part of the liberty of which the citizen cannot be deprived without due process of law under the Fifth Amendment.” Kent v. Dulles, 357 US 116, 125.
    CASE #4: “The right to travel is a well-established common right that does not owe its existence to the federal government. It is recognized by the courts as a natural right.” Schactman v. Dulles 96 App DC 287, 225 F2d 938, at 941.
    As hard as it is for those of us in law enforcement to believe, there is no room for speculation in these court decisions. American citizens do indeed have the inalienable right to use the roadways unrestricted in any manner as long as they are not damaging or violating property or rights of others.
    Government — in requiring the people to obtain drivers licenses, and accepting vehicle inspections and DUI/DWI roadblocks without question — is restricting, and therefore violating, the people’s common law right to travel.
    Is this a new legal interpretation on this subject? Apparently not. This means that the beliefs and opinions our state legislators, the courts, and those in law enforcement have acted upon for years have been in error. Researchers armed with actual facts state that case law is overwhelming in determining that to restrict the movement of the individual in the free exercise of his right to travel is a serious breach of those freedoms secured by the U.S. Constitution and most state constitutions.
    That means it is unlawful.
    The revelation that the American citizen has always had the inalienable right to travel raises profound questions for those who are involved in making and enforcing state laws.
    The first of such questions may very well be this: If the states have been enforcing laws that are unconstitutional on their face, it would seem that there must be some way that a state can legally put restrictions — such as licensing requirements, mandatory insurance, vehicle registration, vehicle inspections to name just a few — on a citizen’s constitutionally protected rights. Is that so?
    For the answer, let us look, once again, to the U.S. courts for a determination of this very issue.
    In Hurtado v. People of the State of California, 110 US 516, the U.S Supreme Court states very plainly: “The state cannot diminish rights of the people.”
    And in Bennett v. Boggs, 1 Baldw 60, “Statutes that violate the plain and obvious principles of common right and common reason are null and void.”
    Would we not say that these judicial decisions are straight to the point– that there is no lawful method for government to put restrictions or limitations on rights belonging to the people?
    Other cases are even more straight forward:
    “The assertion of federal rights, when plainly and reasonably made, is not to be defeated under the name of local practice.” Davis v. Wechsler, 263 US 22, at 24.
    “Where rights secured by the Constitution are involved, there can be no rule making or legislation which would abrogate them.” Miranda v. Arizona, 384 US 436, 491.
    “The claim and exercise of a constitutional right cannot be converted into a crime.” Miller v. US, 230 F 486, at 489.
    “There can be no sanction or penalty imposed upon one because of this exercise of constitutional rights.” Sherer v. Cullen, 481 F 946.
    We could go on, quoting court decision after court decision; however, the Constitution itself answers our question – Can a government legally put restrictions on the rights of the American people at anytime, for any reason?
    The answer is found in Article Six of the U.S. Constitution:
    “This Constitution, and the Laws of the United States which shall be made in Pursuance thereof;…shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or laws of any State to the Contrary notwithstanding.”
    In the same Article, it says just who within our government that is bound by this Supreme Law:
    “The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution…”
    Here’s an interesting question. Is ignorance of these laws an excuse for such acts by officials?
    If we are to follow the letter of the law, (as we are sworn to do), this places officials who involve themselves in such unlawful acts in an unfavorable legal situation. For it is a felony and federal crime to violate or deprive citizens of their constitutionally protected rights. Our system of law dictates that there are only two ways to legally remove a right belonging to the people.
    These are (1) by lawfully amending the constitution, or (2) by a person knowingly waiving a particular right.
    Some of the confusion on our present system has arisen because many millions of people have waived their right to travel unrestricted and volunteered into the jurisdiction of the state. Those who have knowingly given up these rights are now legally regulated by state law and must acquire the proper permits and registrations.
    There are basically two groups of people in this category:
    1) Citizens who involve themselves in commerce upon the highways of the state.
    Here is what the courts have said about this:
    “…For while a citizen has the right to travel upon the public highways and to transport his property thereon, that right does not extend to the use of the highways…as a place for private gain. For the latter purpose, no person has a vested right to use the highways of this state, but it is a privilege…which the (state) may grant or withhold at its discretion…” State v. Johnson, 245 P 1073.
    There are many court cases that confirm and point out the difference between the right of the citizen to travel and a government privilege and there are numerous other court decisions that spell out the jurisdiction issue in these two distinctly different activities. However, because of space restrictions, we will leave it to officers to research it further for themselves.
    (2) The second group of citizens that is legally under the jurisdiction of the state are those citizens who have voluntarily and knowingly waived their right to travel unregulated and unrestricted by requesting placement under such jurisdiction through the acquisition of a state driver’s license, vehicle registration, mandatory insurance, etc. (In other words, by contract.)
    We should remember what makes this legal and not a violation of the common law right to travel is that they knowingly volunteer by contract to waive their rights. If they were forced, coerced or unknowingly placed under the state’s powers, the courts have said it is a clear violation of their rights.
    This in itself raises a very interesting question. What percentage of the people in each state have applied for and received licenses, registrations and obtained insurance after erroneously being advised by their government that it was mandatory?
    Many of our courts, attorneys and police officials are just becoming informed about this important issue and the difference between privileges and rights.
    We can assume that the majority of those Americans carrying state licenses and vehicle registrations have no knowledge of the rights they waived in obeying laws such as these that the U.S. Constitution clearly states are unlawful, i.e. laws of no effect -laws that are not laws at all.
    An area of serious consideration for every police officer is to understand that the most important law in our land which he has taken an oath to protect, defend, and enforce, is not state laws and city or county ordinances, but the law that supercedes all other laws — the U.S. Constitution. If laws in a particular state or local community conflict with the supreme law of our nation, there is no question that the officer’s duty is to uphold the U.S. Constitution.
    Every police officer should keep the following U.S. court ruling –discussed earlier — in mind before issuing citations concerning licensing, registration, and insurance:
    “The claim and exercise of a constitutional right cannot be converted into a crime.” Miller v. US, 230 F 486, 489.
    And as we have seen, traveling freely, going about one’s daily activities, is the exercise of a most basic right.

I echo this, again and repeatedly; “Have you unknowingly waived your rights?” Their presumption is; you waived your rights KNOWINGLY and, “party having superior knowledge who takes advantage of another’s ignorance of the law to deceive him by studied concealment or misrepresentation, can be held responsible for that conduct.”
    Ya’ll need to get in the habit of prosecuting ANY ONE who attempts to decieve you. It’ll only be a matter of time until judges refuse to see cases as, to rule in favor of the “fed” is to shoot them selves in the foot and open them up to personal liability.

    If you don’t know your rights, you don’t have any. Quit yer bitchin’ if you think you are being oppressed. You let them do it to you. You asked them to. It’s your own fault.

    5 WORDS THAT ENSLAVE;

    PERSON is a legal entity, a trust, corporation, partnership, association. (The Supreme Court ruled this to be so for Obama). Attorneys can only represent “Persons”. Note what I mentioned else where in this blog; Use an attorney to represent you? You are deemed a “Person”.

    RESIDENT establishes “State” jurisdiction. To “reside” is a commercial term used to establish domicile for tax purposes.

    CITIZEN establishes federal district jurisdiction, again for tax purposes. The IRS only taxes citizens. The 14th Amendment Citizen? Seeing it now?

    DRIVER is for hire. A paid operator of a motor vehicle for gain or profit (what is taxable). Motor Vehicle solidifies it. Such as a tool the “Driver” uses for profit and gain.

    PASSENGER is one that pays a fare for passage on a commercial transport.

    Adding suffix or prefix to these words do not change the root meaning.

    When you get a notice for jury duty and it requests that you check the box if you are a “U.S. Citizen”…..you just gave them evidence that you are still a slave and under commercial jurisdiction, and all that that implies. The term “U.S.” is defined as a private corporation. Put the two together and,…send it back and request “which U.S. Citizen is defined here?” There are three. You didn’t know, didja?

    No matter where you see or hear these words, it’s a trap. It is evidence against you if you respond to them.

    If asked why tell them you will be appealing if found guilty.

    If time does not allow then go to court on the date shown on the ticket. About a 50/50 chance the cop does not show. If He does show ask him when your case is heard what the legal definition of a motor vehicle is, driver is, passenger is etc…

    You can also get the judge to recuse himself as well through questions.

    A few years back I had a run in with a supposed cop friend. Won’t give the details I’ll just say I was entered into the system as a guy to ticket each time the plates were run. Got four tickets in 12 mos and said enough’s enough and educated myself.

    My avg ticket was $500.00, do the math. I almost sniped the last pig. Couldn’t sleep that night, only tossed and turned trying to plan out his death. Actually came up with a workable plan and put it on the shelf for the future. At this time I’m in the system as a time waster and to let go with a warning.

    You guys have read posts made here where we have stated that every one should go “loaded”. We have stated many times that the SOP is for them to strike when you are at your most defenseless position which is usually while you are on the road.

    This report confirms exactly what we have been saying for years.

    It is their tactic to attack in areas where you cannot go forward or advance to the rear. These are usually called check points.

    Bridge crossings, state lines, interstates are all subject to this type of attack.

    So,be advised. I know you guys are smart enough to know what back roads to take in order to escape and evade. Now is a good time to put that into practice before all major interstates are subject to this bullshit.

    The river crossings shall prove to be difficult. There are only so many bridges across a river. You must be west of the Mississippi and northwest of the Missouri breaks in order to successively get away.

    Sadly, I am compelled to enter the thick of it. Our best chance is to counter it when it is new and hot. If we were taking these people to court right at the onset, they won’t have forward motion for others to become complacent with the regularity.
    No, I’m not a fool nor a martyr, it’s just now, too many others will lay down unless some one else tries. I hear so many times; “It just takes too much time.” or; “It’s so inconvieniant.” I want to slap the stupid out of their mouth.

    The only weapon (now, this is just my opinion) we should use now is Law. (not “law” for those wordsmiths. “Legalese”.).
    I understand though, that I won’t be able to do that for long. Eventually, I’ll be a victim of a drive-by at some gas station. An innocent victim. Happens all the time.

    I won’t live in fear or as a slave though. There is no compromise. There can’t be. Enlist or surrender, those are your only two choices.

    Yea, it sucks. I have a family, I enjoy them and life all around………but what else can you do? Seriously? I won’t surrender to this. I won’t allow it, with every fiber in my being, for as long as I draw breath.

    Maybe you don’t always agree with what I say, or take it other than how I meant it but for sure, we all meet here for the same, core reasons.

    Tennessee is a major passage for the South East. Lots of truckers and lots of vacationers passing through but, the “residents”, living in back woods and tucked in residentials won’t be bothered as much. They’ll hardly be imposed on so, they won’t fight. They probably, barely, heard a whisper about it.
    They need to get it rolling some where so they can demand more funding for the program to expand.
    Educate, learn, remember. Start gathering their information, even the goons at the Airport. If you miss your flight because you were “detained” or you don’t make it to Grandma’s or your delivery is a day late, you sue them, personaly, for impeeding your right to travel.
    I know, what a pain in the ass it is to do this. What else can you do with out waiting until it’s too late and then having to literally fight for your rights?
    They want it to be difficult. Persist. You file the papers once or twice, you’ll be banging them out at coffee breaks like it ain’t no thing.
    It’ll become a “Oh, sorry, I’ll be in late today. I have to go collect my $2k, strike another for America and, see my friends down at the court house for another laugh.”.

    The TSA has NO jurisdiction. Sue a couple and they’ll pressure the government for protection, and there’s nothing they can do. Now that you got good at Writts and Affidavits, show some one else how. There’s so many fan ways to use them.
    The courts are ours. We really need to work at taking them back. We can fix all this. We just need to be mean MFer and do it.

    By the way, Congress does not have the power to create any new offices. These TSA workers are paid by taxpayers? How does the “government” do that if they are not allowed to? Hmmm,…wonder if it isn’t really the “government”? How else could they,…..?……nah.

    good question, I would think they were in other states wouldnt you? I dont know what part of Tenn that this was taken but Knoxville is the Only place in the US where the two interstates 75 North and South and Interatate 40 East and Weast intersect, 40 being coast to coast and 75 from Fla. to Canadian border.
    May be the next place for a false flag, who knows.

  20. I drove Tractor Trailer for years and just stopping at the weigh station was a pain and if you are trying to keep a schedule and you get a random search, your whole day is fucked up. This whole TSA thing is going to piss off the truck drivers. These snitches on the road better watch out, because most of the drivers are cool and professional. I had to get out of the business in 07 because of my disability, but I’ll be willing to bet the other truckers will be finding alternative routes. The CB is a great thing to have in your car to monitor traffic conditions and where the Bears are, Where are the TSA…?
