In a victory for the New Deal bastardization of the Constitution, the Supreme Court has ruled that the government can mandate at gunpoint that Americans buy monopolized health care insurance.
“The Supreme Court upheld the health care law today in a splintered, complex opinion that appears to give President Obama a major victory,” reports USAToday.
In order to avoid arguments that the law is a misinterpretation of the Commerce Clause, the Court ruled that the requirement is a tax.
Justice Anthony Kennedy, who held the court’s swing vote, dissented. Reading from the bench, Kennedy said he and three conservative justices believe “the entire Act before us is invalid in its entirety.”
Polls conducted prior to the landmark vote indicate most Americans do not favor the law.
Today’s ruling is important because it is the first time in history that the federal government has required citizens enter into contract with private corporations to buy a product or service. It also represents one of the most egregious violations of the Constitution in American history.
“The insurance mandate clearly exceeds the federal government’s powers under the interstate commerce clause found in Article I, Section 8 of the Constitution,” writes Ron Paul. “This is patently obvious: the power to ‘regulate’ commerce cannot include the power to compel commerce! Those who claim otherwise simply ignore the plain meaning of the Constitution because they don’t want to limit federal power in any way.”
“The commerce clause was intended simply to give Congress the power to regulate foreign trade, and also to prevent states from imposing tariffs on interstate goods. In Federalist Paper No. 22, Alexander Hamilton makes it clear the simple intent behind the clause was to prevent states from placing tolls or tariffs on goods as they passed through each state — a practice that had proven particularly destructive across the many principalities of the German empire.”
Expect death panels to come back in a big way now that Obamacare is the law of the land. Now that there is no fear of political backlash, death panels will be sold as a measure to reduce medical costs which will predictably skyrocket (as costs do of anything government touches).
If you are skeptical of this, consider a recent report in Britain. “NHS doctors are prematurely ending the lives of thousands of elderly hospital patients because they are difficult to manage or to free up beds, a senior consultant claimed yesterday,” the Daily Mail reported last week.
It is being sold as a “death pathway” that is the equivalent of euthanasia of the elderly.

Oh yes it is time for the reckoning! This is a very GOOD thing for freedom. It will give a giant shove to all those on the fence about being a slave no longer!
This ruling won’t affect my finances and those who choose freedom and rule of law.
All the rest of the people who will have to submit their financial info, including ALL their assets, for complete evaluation, be told what insurance to buy, how much to pay, and if they don’t buy, and provide proof on their IRS 1040, will have to pay a $5000 fine for not buying it!
How many people will stop filing those confession forms on April 15th? ! I stopped 20 years ago when I learned it was all BS. Still here and not a word from the scumbags! It just might be because I am on their PDP list, (Potentially Dangerous Person). So they move on to the easy fish who “volunteer”!
Good luck with that confession form and all that stress that goes with it or choose NOT to volunteer any longer!

I do agree with LibertHound though that it’s in the citizenry’s best interest that the government moved towards their intended tyranny in drastic moves rather than slow methodical decade encompassing plans. A high precentage of the population just doesn’t have the tenacity nor memory span to deal or pay attention to what’s going on.

You don’t need to be a part of it. Been saying all along that it IS constitutional for them to enforce the mandate IF you are an “individual”. It is as easy to look up their definition of “individual” and realize that you are not that.
As an “individual”, you are presumed to agree to the bill and waive your rights.
It is that friggin easy. If they said; “All morons are required to have healthcare or pay a tax”, you certainly wouldn’t worry about it then,…or would you?
The fix (Kagan and Sotomayor) was in. I knew they would argue it as a tax increase. The vote appeared to be very split.
Taxes are usually specific, written into the Constitution. There is nothing in the U.S. Constitution that says you have to buy any particular product.
Now we all have to buy Buicks, or else. Doesn’t matter whether you need it or not.

Agreed Matzo. Because this passed they can now use that same argument to tax anything out of existence. Your guns? You can own them but only if you can afford a TAX. Your freedom of speech? Sure…. just pay a tax for it, for a “permit.” Your rights? Sure… just as long as you can AFFORD the tax on living. The air you breath? Sure… so long as you pay your TAX.
And how are they going to KNOW if you have health insurance or not? Why, those that have health insurance are chipped and in the system… while those that are not chipped get HEAVILY TAXED. See where it’s all going. Goes a lot farther than just requiring you to eat broccoli.

Poeple dont understand…obamacare was introduced because those who did not own insurance in free market would see their bill shiped to the gov as hospital wont let you die because you dont have money.But now its bankrupt and gov can’t handle healthcare bills from those who dont have free market insurance…so if obamacare is removed poeple who can afford to get insurance from free market will end up without anycare and may die if they’re about to.That is the evi nwo to let poeple die because they dont have money to insure themself and that is against constitution when the srong ones dont help the weaker ones.In fact all healthcare hospital should be nationalised and law should be introduce to prevent market to make money out of sick poeple.

For the record, buried ‘neath Keynesian rationalization is it’s predatory function to press an increase in hardship during a recession, which is occult protocol. I am really having a hard time with this one. I thought there might have been a semblance of hope but that hope has been completely smashed to pieces. I fought for our Constitution as hard as I could for 8 years and 3 tours to the middle east while serving in our military and for the first time in my life I feel like it was completely and utterly in vain. There is no where left to go except for your gun safe. What I fear more than anything and it is blatantly apparent that our second Amendment is next and it WILL be destroyed.

While I agree the law has flaws that need to be worked out, since it was enacted, I get to have insurance again when I couldn’t before. Therefore I won’t have to rely solely on the emergency room, driving up costs you would have to help me pay. So there are parts of the law that are good, it just needs more work.

In a correct and common sense world, war should be backpeddled and the citizens put first. Unfortunatley, the King of Peace Obama will have it the other way around and rob your paycheck in the process (If you have one). Being forced to buy something that is quite likely of poor quality, would have any Ombudsman shitting their pants. Amabo (backwards) and his departure should be the highlight of the American’s life, like slaves throwing off their chains.
This is going to not only make the mandate a huge issue in the election, but could finally wake people up that the Supreme Court needs term limits.
There is absolutely no question that you cannot mandate people to purchase something. The government’s authority is to tax and to allocate that tax revenue for spending. It can’t be a tax and a mandate at the same time– it cannot ride upon two horses.
This law will result in huge losses for Democrats this fall across the map in Congress. This is the biggest job-killer since the crash of 1929.
Nullification is next.
Last chance for freedom in America is Nov. 2012.
And that does not mean the presedential race as there is no difference between the candidates – they are both controlled by the same banksyter cult.
Any Congressman in office needs to be held accountable for this Nazi government and any Congressman running for office needs to be voted for on the basis of does she/he have the guts to change the corrupt, dictatorial government for the better.
Give people a choice. If they don’t want to provide their own, OR be un-insured, then they can opt in to pay the 1% tax and be on gubberment deathcare. If you don’t want to be insured, then so be it. Why force it down our throats? Oh yeah, they are running out of money so they want to tax everyone to death under the ruse of keeping us healthy. I now pay for insurance that I rarely use. I look at it as an “in case I get really injured or sick”. I hate doctors and I refuse to go unless I am bleeding gallons of blood, or can’t breathe.
