Teacher’s Aide Assaulted Special Needs Child & Posted Video to Facebook

A 9 year old boy with special needs was attacked , assaulted and dragged by a teacher’s aide at Tobinworld, the school he was attending at the time.

The beating was caught on video via a cell phone. It shows a woman named Ms. Kamaljot Kaur attack the boy who later described how the teacher’s aide “put her elbow in” the child’s neck and continued to “slap” him hard in the face.

A 3rd employee of Tobinworld saw the video clips and told local media “this is the third time (since Monday) this kind of thing has been recorded by him, it was so unbearable to watch I had to do something about it.”

Officers arriving at the school determined that a felony child abuse had happened and Kaur was arrested.

Kaur and the other staff members involved in the video were suspended, then fired, according to Annetta Giambruno, official for Tobinworld.

Stephanie Anello, interim superintendent for Antioch school district, confirmed that Tobinworld is a “nonpublic school that serves special needs children in the community.”

Abusing special needs children seems to be a problem across the country.

Last year the American Civil Liberties Union (ACLU) and the Children’s Law Center (CLC) are suing Kevin Sumner, a Kentucky sheriff’s deputy, for handcuffing 2 disabled children because they had misbehaved during class.

In a video released by the ACLU, one 8 year old 3rd grader was shackled down by the resource officer and sheriff’s deputy at the Latonia Elementary School (LES).

The child was 3 feet and 6 inches tall and weighed 52 pounds when he was removed from class for not following the teacher’s instructions.

Upon trying to leave the principal’s office to use the restroom, the boy was physically restrained by school administrators until Sumner arrived and escorted him to the bathroom.

The 8 year old boy in the video has been diagnosed with post-traumatic stress disorder (PTSD) and attention deficit hyperactivity disorder (ADHD) and was sent to the principal’s office for “disability-related difficulties complying” while in class.

When walking back to the principal’s office, Sumner alleges the boy “tried to hit [Sumner] with his elbow” and this is what led to the child begin put into handcuffs.

Sumner placed the boy’s hand behind his back and handcuffed him at the elbows to keep him restrained, while telling him: “You can do what we’ve asked you to. or you can suffer the consequences.”

The 7 minute video, filmed by school faculty, depicts Sumner telling the struggling little boy: “If you want the handcuffs off, you’ve got to stop kicking.”

This statement comes after the child begins to squirm and cry.

Sumner said to the boy: “I asked you not to kick. Now, you give me the behavior that you know you’re supposed to, or you suffer the consequences. It’s your decision to behave this way.”

The officer left the 8 year old locked up for 15 minutes.

In Kentucky, a child must be shown to be “a direct threat” to themselves or others before this type of restraint is lawful for use. However, in this case, neither the boy nor the 9 year old girl also involved were an “imminent” threat. And because of this incident, both children have “experienced pain, fear, and emotional trauma.”

And in 2013, Sumner was involved in the restraining of a 9 year old girl weighing 56 pounds who was sent to isolation for “being disruptive” while attending the John G. Carlisle Elementary School.

Once again, the girl “tried to leave the [principal’s office]” and was placed into handcuffs by Sumner.

The girl was restrained at the elbow, just as the little boy. It was alleged that the small child was trying to “injure school staff”.

Sumner called for a “medical crisis team” to take the girl to a hospital “for a psychiatric assessment and treatment” after determining that the child had “a severe mental health” problem.

Nearly a month later Sumner handcuffed the same girl again because she ran away from him. Sumner told her to go to the cafeteria.

In his report, Sumner claimed the child “was attempting to assault him” so he handcuffed the girl with her arms above her head. This pain compliance technique “is dangerous for children”.

Robert Sanders, attorney for Sumner, said his client only placed the children in handcuffs because “they were placing themselves and other people in danger of harm and that’s what the book says to do. Kevin Sumner is one of the best and most highly trained school resource officers in Kentucky.”

Sander continued: “He’s a teacher who left that profession to become a police officer. He’s totally devoted to kids and schools and education. I predict after a whole lot of hoopla this will go away and vindicate officer Sumner.”
